    City marshall for capitol one

    Hello All

Just found this site. I received in the mail today a letter from NY City Marshall for wage garnishment for CC debt with capital one. It says I have 20 days to respond with payment. My main question is if I call do I have a chance of negotiating a payment plan of less than 10%. Like maybe $50 a month. My gross pay is enough to pay the 10%. But in the real world we know we don't actually see the gross and there is a ton of other debt.
    I can't afford the 10%.

Will I have to show proof of income to them?(I read here on anther thread that they simply ask what your income is)
If they simply ask how much I make what shuold I say that will make them agree to $50 a month or less if possible?

    Thanks for any help

I am assuming you are talking about the nyc marshall. If read the other thread then you read what I did when I was in a similar situation. I called their office and said that I wanted to make payment arrangements. They asked me how much I made and I told them an amount that was way less than what I really made at the time. Then they calculated 10% of that and told me that was my monthly payment. They said that I had to mail checks twice a month (because that is how I told them I got paid) and that the checks had to be mailed to be received by a certain date (which they gave me over the phone). They also told me that if the check was late, they would proceed with the garnishment.

By calling them well before the deadline you should be able to get a payment you can afford. Just have the salary amount ready to tell them when you call because they ask you questions very quickly and you won't have time to figure it out on the phone when you call them.
You can't take a picture of this. It's already gone. ~~Nate, Six Feet Under

If they have gone through the trouble to do this, they may be done negotiating. Capital One is very serious about collections.
I am a Pennsylvania Eastern and Middle District Bankruptcy, FDCPA, FCRA and Foreclosure Defense attorney, information I post is based on experience in these districts. It is not legal counsel, consider it friendly counsel.

Thanks for the replies. I hope its not as Jim said and it to laye to negotiate. I just got the letter Saturday 10/24/09 and it states you have 20 days to call and work out a payment plan. I plan to call Monday. I have figured out a salary where 10% is about $60 bi weekly that's how I get paid. So, I hope it works out in my favor.

If you are in nyc and are calling the Marshall's office that is how it will work based on my experience.
