Does asking for a DV almost always end up in a lawsuit?

    Does asking for a DV almost always end up in a lawsuit?

    So when my CCs start a-callin' again I planned to ask for DVs on all of them, just to see if anyone messes up. But I have been reading that while the DV is answered, it is often followed immediately by a lawsuit for judgement. Not what I want obviously.

    Any experience?

    I must have it confused with a C & D. That makes more sense.
    I am thinking that the CCs are not gonna mess around with me seeing as I already filed and was dismissed on a 7.

      When they start calling again, once the Ch 7 dismissal is processed, I will send letters to those callers asking them to validate the debt. If they do not validate the debt, then how are they able to collect?

      I understand what a lawsuit and a judgement are. I am sued (a lawsuit) and the credit is awarded a judegement that I am to pay/have my wages garnished. Correct?

        I will not be refiling anytime soon unless I get a wild hair and quit my job in order to pass the means test. I have no assets, so no big deal there. Only my wages to be garnished. Hubby has an upside down house that we are leaving soon, unless the lender gives us an awesome offer to stay in the next month. Doubtful. But there is nothing that anyone could get from me besides a garnishment, and they will have to get in line behind the student loans if it comes to that.

        The reason my 7 did not work was because we had excess income by $2400/mo since the UST and Judge would not allow my student loan payments as a special circumstance that had to be paid, thus leaving NO disposable income.

        Thanks for the info re: OC versus CA.

          Oh and your signature just has a link to a page with a giant 8 ball that you can type a question into....are you supposed to type "will I get sued?"



          And does a C & D normally end up in them suing you?
