And what's up with NCO? They called and called and called and called for about 3 weeks. Haven't heard from them in over a week now.

I've got some interesting info on NCO I'll try to post in a few days.

It is amazing how some CAs get aggressive, others don't. For mine, BoA's CA seemed quite aggressive, but my BK put a stop to it, hopefully (Glasser and Glasser, based in Richmond, VA).

Frogger and Albacore, your avaitars...I gotta say this, if these two people met in real life, how about they go out on a date? Unless these pictures were edited through photoshop maybe?

                    Paging Albacore

                    I'll join the list:

United Recovery Systems, in Houston, for HSBC

Just got the letter today after first call last week.

Albacore (or anyone else) -- should I ask for "debt validation" first in writing, or just go directly to C&D and ask them to stop calling? I wouldn't care about email but I'd like no more calls. Lately I have been turning off the ringer most of the day, but of course then I am missing a few calls I would WANT to take.

If I send DV first...what exactly do I say? I KNOW the HSBC debt is mine and have all the statements to prove it. They likely know this. So what is the point, really? Just buy some time?

Oh, when URS first called last week, the rep told me "it says you are refusing to pay." What IS this deal with the emphasis on "refusing" ? I of course explained I couldn't pay, as opposed to not wanting to pay....

Only CA thus far is GC Services for GE Money. They have an office here and a flagrant disregard for the "all calls are inconvenient" in a letter that they signed for.

My letter was four sentences summed up with "I am disputing, this is NOT a refusal to pay, please send validation, stop calling as all calls are inconvenient." I did not go into all the legal stuff as they know people cut and paste. Plus they know the rules...if they didn't they would not flagrantly disregard them and hope people are too chicken to sue.

Refusal to pay is just something they use as a scare tactic. Can't=refusal. "Won't give bank info over phone"=refusal. "Have no money"=refusal. Does not matter what you tell them, anything but "here is my account number, help yourself" is a refusal.
First consult: You go now, no CH 7 for you. You spent entire buffet. 13 has a 95 percent payback. (Owwwch) On to next consult....

                        Mine were:

                        NCO for American Express
                        Allied for American Express

Those were the only two charged off before I filed BK earlier this month.

I'm a little late at jumping into this discussion, but I would consider sending a "Do Not Call" letter prior to any type of validation of debt letter. Just my opinion, but I never sent a validation letter unless I was being challenged by a collector. I did the do not call thing early and it helped until the debt transferred to a collector.

On the matter of "REFUSAL TO PAY", I had the same thing. I was told it was a refusal because I wouldn't verify any information over the phone. I tell them I don't handle financial matters over the phone and to send it to me in writing. They don't like it. But I still did it. I hardly get calls now...only one and I'm not sure who it is because they call my cell phone and it's not showing up. I know there is a website you can use online to look up who is calling you, but I dont' remember the name off hand. Google "Who is calling me" and I'm sure there will be information there to find out if you want to check a number?
