    Looks like HSBC wants me to file sooner.

    So, it has been about 7-9 months since defaulting on my Best Buy account. To which they are still accruing interest and fees on the account.

    To which, today I receive a letter in the mail, this one to me looks serious, as it is actually signed by an attorney, and I checked it with a magnifying glass, it is not a stamp.

    Reality, a slap in the face it hurts, I have put off the filing so long, the nerves still set in.

    A docket search only brings up 4 cases, bearing the firm's name, and the o.c. brings up only 1 2009 case.

    They either are really good at collecting, or it is yet again another bluff, this would not be the first time a local firm has obtained my debt and never sued. But that local firm was Mann and Bracken, and we all know about them.

    Hsbc sued me for a 3k card that was only 6 months of non-payment. I had cards from amex, citi, and chase etc that had MUCH higher credit limits that never sued, but hbsc sued me pretty quickly. They were trying to go for a salary garnishment on an old job that was listed on my credit report. (I no longer worked for that company.)

      sorry to hear about that. i keep scrubbing my numbers and scrubbing my numbers, so I can make sure I can slide in with a Ch-7 filing in January. I'm waiting for my letter from Mann and Bracken, since they so kindly put a hard pull on my CR. Not sure if the sue here in Ca. , i could not find their names on my court docket

        their gonna love me when i charge off my $250K HELOC, and stop paying after my discharge.
        Stopped Paying CC's 2/2009. Retained Attorney 1/10/2010 Filed 1/23/2010. Discharged 5/19/10 $187K CC, $240K 2nd,$417K 1st, No asset Ch-7

          Frankly I was very surprised at how aggressive they were for 3k. I was living in nyc at the time, and they hired a sleazy law firm that the attorney general is going after. They did "sewer service" on me, (filed a judgment without ever properly serving me papers) and I received a notice of garnishment (from a job I no longer had) before I ever knew they had sued me.

            HSBC is who first upped our rate to over 30%, there reasoning being we were late (1-2 days) over a 7 yr period (1-2 times). Wouldn't even consider lowering it, told us we could try in a year to get it lowered. Highest balance card. More then tripled our min payment. At that time we had never been late on any cc, never missed a payment on anything. Our credit score was still above 740.

            There were the first to sue 1 yr 5 months after we quit paying all cards. Even when we had our rate increased and we begged and I broke down crying because I knew we couldn't make the payment, they didn't care. So filing on HSBC is what finally broke the camels back so to speak, and filing on them actually brought me pleasure. They are what pushed us to finally do what we should have done years ago, so in a way we owe them for our fresh start! Thanks HSBC!

              HSBC turned me over to a local attorney and they are going to sue me... These guys got me once before so I know I will be getting papers soon.

                How the hell did they get a judgment/garnishment without a court date??? I am still trying to figure this out. I am reading........

                I am trying to get to filing but keep getting set back. I just dont want to have that happen to me. I will be filing in a week or 2. I have a best buy acct also and am waiting. More worried about well fargo. I would also like more info on finding out the docket thing. I still dont believe they can do that without notifying you...Damn it is killing me.

                  They file the suit in the name of their client. Check not them but the original creditor(s).

                    Well in nyc there are law firms that are known for doing what is called "sewer service". What that means is sending the summons by mail to the wrong address, or never sending it at all, or claiming it was delivered when it wasn't etc... These firms got away with this for years, but recently (July 2009) the New York Attorney General Cuomo filed charges against them. He filed charges in July against 37 law firms.

                    The funny thing is, that first default judgment made me decide to start planning my bankruptcy, and if Cuomo wins this lawsuit against these firms, my judgment will be vacated. Cuomo is suing to vacate over 100,000 default judgments that were obtained by so called "sewer service". My default HSBC judgment is one of them.

                      I checked HSBC Bank Nevada, I found plenty of 2008 suits, but only 1 for 2009? You live where I live, check it and tell me what you think. I kind of want to beat them to the punch and get this filed already, but I need some cash, which is very hard to come by in my situation.

                        i hear ya...thats what I am trying to do (beat them to a judgment). I concour on the money thing also. I finaly am in a position to file but just waiting for the money now. I got a suprise last week, last 2 late bills that need to get done. The money i was planning to file with needs to be used for these. Just getting impatiant!! Man I cant wait, oh the sweet releif!!!! I think I will get the credit counseling course over with tonight.

                          Thanks for the reply.....I think I understand a bit better. Is this legal in all states or did it just happen in NY?? I just want to make sure i am notified before a court date. Which i would think they would need to obtain a judgment. That "sewer service" sounds like some shady crap!!

                            This happens everywhere, but New York's Attorney General is doing something about it (finally). If your debt was purchased by a JDB, they commonly employ these tactics. Many collection lawyers employ these tactics. The good news is that the judgment is often thrown out if you fight it and say you were never properly served. I was working 65+ hours a week at the time, and didn't have the time or energy to fight the default judgment.

                              Thats my whole point...how can you fight it if you know nothing about it? Man I hope they dont get me. I am so ready to file!!! Like I said Wells are the only ones I am worried about at this point. They threatened "employment verification" last night when I attempted to reason with them. They were fine until I told them i would not set up an auto pay. I told them to send me a statement and I would happily pay them, but i needed a document for a reciept of our agreement. Yea, yea, i know I dont need to be answering the phone. Just thought i would try again to reason.
