    How long are they going to call?

    I'm on day 47 of my 60. Today I got a call from RecoverCorp Inc. These are the people that tacked on 8k to the 32k I owed the OC.

    The OC was clearly listed on my list of creditors. I checked to make double sure.

    How long can they get away with calling me? Should I call my atty?

    I am assuming you filed your BK already?

    If so, hopefully you also added the collection agency in your schedules as well.

    They are in clear violation of the automatic stay, feel free to notify your attorney.

      The original creditor was included, I'm not sure if this collection agency was included. We filed 6/10/2009, I don't know if this collection agency had the account then.

      Isn't the original creditor sufficient?

        Yes the original creditor is absolutely sufficient. How are you supposed to know who they have sold your account to? To allow otherwise would invite chaos.

        The account number is supposed to be listed on your schedules but as we all know that can be a moving target as well.
        filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

          If you filed and you got 'a' call from a stray CA why don't you inform them you filed? People get calls from creditors after they have been discharged, it happens. No point in calling your attorney unless something really obvious is going on IE; the same collection agency keeps calling or the OC keeps assigning your debt to a new CA once they have been told you filed.

          Just keep a detailed record of who called, date , time etc, in case you need it in the future to pursue a claim.

            True, but these idiots need to be whipped into shape, so a phone call from an attorney threatening a suit sounds so much better, besides you are paying the attorney lots of money, make him/her earn it.

            Lots of people simply dont want to speak to collectors period, so if you have an attorney, use him/her.

              For some reason I thought I seen a post about adding everything on your schedules, credit matrix. I hate digging for old posts though. You are probably correct though.

                Have you told them you filed, and gave them your case #? If so, and they're still calling, then you need to inform your attorney.

                  By way of introduction, represent Mr. and Mrs. Bankruptcy in the filing of a Chapter 7, Title 11 Bankruptcy.



                  This letter is being written in response to a call received from my clients who, complained about your continued calls. Two employees from your company, A and B, were the employees who contacted our Debtor. Mrs. BK stated both were very rude and she has two witnesses that heard your employee yelling at her. Mrs. BK has provided your company with our name and number; however, our record show that no one from your company has called regarding this matter.



                  Company X, the original creditor is properly listed in the bankruptcy and Notice was properly forwarded to you directly from the U.S. Bankruptcy Court. You should have received notification of the filing from the original creditor.



                  The intent of this letter is to inform you that you are in violation of the Automatic Stay. You must cease all contact immediately. Any further contact, by mail or other correspondence, may result in sanctions being filed against DirtBagCollections.



                  Of course, if you should have any questions that I may be able to answer, please do not hesitate to contact me or my paralegal, Ms Wonderful.

                    Sounds like that should work.


                    I went to my lawyer about an agressive original creditor. The creditor claimed they were still going to collect after being told we filed bankruptcy. My lawyer told them that if they still keep on calling, that legal action would be brought against them. After a pause (I guess the creditor googled the lawyer's phone number), the creditor agreed to stop calling.
