We have gotten on credit that continues to call us. We have not filed yet, but paid for our intial consult. This week we actually file. One creditor keeps calling even though we have given them the attoneys name and number. Hubby finally got tired of it as they called him 6 times on Sat. Barcleys is the name. Anyhow, he gave the guy the attorney name last week and phone number. He was on the cell phone and driving his car, and gave the guy the last 4 digits as a name like DEBT, because that is how he knows the number, not by the digits. They called all day long on Sat, and hubby got mad and asked them what country they were in, INDIA... so he told them to have an American call him, they did and he was told that he had to give them the actual number as they are in INDIA and can not figure it out.. I ask you, is that our fault that a business decided to export its jobs overseas while we are laid off over here.. and then make demands of our time to compensate for their lack of training or ability overseas? Hubby was ranting mad. I hope that is the last time they call, I think his blood pressure went thru the roof.

Ask them a lot of questions too. It really bugs the heck out of them and they have to keep apologizing for not knowing. I had a couple foreign collectors that called me and I would make up a law that they were violating and demand their name so that I could file charges and sue. Things like a violation of the Federal Cacophony of Solicitors and Collection Agencies law. Specifically the Fecal Retentive Agent subsection.

Turn the ringer off and forward to voice mail. That way you have peace and quiet. I did.

I agree, turn off the ringer. You've already told them your filing. I have one OC that I told I was filing for BK, gave them my atty info and I have their voicemail that they called and verified with my atty, but they are still calling me, but I no longer answer their calls.
Edit: I also updated my number to Google voice and it sends them straight to vm.

I made the mistake of telling one creditor I was going to file before I filed, and gave the name of my attorney. The creditor just started laughing. And said "well if and when you actually file, I will deal with that then."
Bottom line: Until you file, the creditors can call, and they hear people saying that they are thinking of filing all day every day.

I really wonder why people are conditioned to answer a ringing phone. And if you have a decent cellphone you can add these numbers to the address book and program them to not ring.filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

Barclay's is aggressive as it is. I had them calling just about every half hour 7 days a week. I don't answer calls with no caller ID info, and they only way I knew it was them was because I answered when the first started calling.
The only time they ever called any other number was when they called my work. I told them not to call again, and they didn't. That was a couple of days before I filed.sigpic

Keep in mind that if you don't answer the calls from collection agents, they MAY start calling other numbers in attempts "to locate" you. They could call your work leaving messages with your admin, your receptionist or anyone that answers the phone. They MAY call your friends and/or references to leave a message for you.
I even had one collection agent that went so far as to call several people in my small town with the same last name as me. All in attempts to locate me. That is why I am not a proponent of the ostrich approach... "Don't answer the phone just stick your head under the covers."

Original creditors are a pain in the arse. Cause most know they aren't subject to FDCPA and C&D letters...though some will honor them. So the first six months are the worst. I know it is really hard to talk to them. I decided I couldn't handle the pressure. You might want to call into them every so often just so they can mark your account as contacted...I have found that the inbound collectors are much more low key than the outbound ones, who are pre-disposed to hostility as soon as you answer.filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

As much as the FDCPA is touted, CA's really dont have to provide you with much of anything at all. I had one respond within 4 days of them receiving my DV request. Others, simply dont even reply to my request, but they continue to report it on my credit file, which I have yet to dispute, only because it would be a waste of time.
They sent me back a letter, stating the account # and original creditor, and basically stated, this is your verification, it was pretty funny actually. I am not afraid of them though, they are out of state and have no local offices.
I am waiting on them to start calling so that I can promptly send a C&D.

Thanks for the tips. I will try calling them. Tomorrow is the big day to give the atty the money and all the bills. We have finally managed to save up enough to do this part of it. And now I will need to say another 300.00 I think. I just hope it all goes smoothly. I am still very worried about my job, and very worried about BOA in MO kicking us out of our home in the middle of all of this. Finding a new place will be hard I am sure, if not impossible and we can not afford to run out west to family. We have no one here in town to turn to if we are tossed out.
At work they had a better job open up and I doubt I will get is since I am a boomer, and I do not have a college degree. But I did apply and it would pay better. If I get that after I file what do I need to do? Will I need to give me copies of the new checks or will they need a letter about the increase? Chances are very slim of course, but just getting ready. That might put us over the 7 limit, scarey thought into 13, but it is what it is. I think it is too low when you compare the horrible wages here and the cost of healthcare insurance and food and taxes. Geesh.. rip off state.
