      There is a lot of "noise" on this thread and name-calling as well which has been noted and warnings given.

      We do not tolerate name-calling here, period. If you have a serious disagreement with another member, that's fine....but the argument must be conducted in a respectful and civil manner.

      If you can't resist 'poking the bear' or another member really annoys you, please turn on the Ignore feature for that member. If name-calling or other rule-breaking behaviors happen, notify the moderators via PMs with the link to the problem thread or individual post included. It's our job to confront members who are violating forum rules, not yours.

      If these thread-jacking personal vendettas continue, then the members who participate in them will receive suspensions from posting for a week or more. If the violations continue and the members have already been warned once, then the members will be banned permanently.

      C'mon folks.....we're all in this bk boat together. No one wins when these flame wars flare up and get out of control. However, the moderators will stop them with temporary or permanent bans as necessary.

      Now everyone has been warned....time to move on.....let's get back to the business of helping each other get through some of the worst times of our lives.

        We owe them almost 18K. (on this card) I don't think our income is particularly high for our area. We make about 100K between the both of us and live just north of SF. I thought maybe because I ignored all their attempts to contact us.....I don't know. Maybe they are just d@#ks.

          Well I made over 175k a year when I stopped paying my amex. I ended up bking around 23k with them that was broken into two cards.

          They kept sending me offers to give me an guaranteed optima card if I paid the balance. I got these offers for a YEAR right up until declaring bankruptcy. So I have NO idea why they are suing you, that is really strange.

          The collection agency that they were working with was NCO. NCO kept calling me and sending me letters that if I paid the balance, even over time, they would give me a guaranteed optima card for half the credit limit I used to have with them.

          What kind of amex card is it? Mine were credit cards, a blue card and a card called an nyc card that they have since discontinued.

            It is a Platinum Optima card. I have an Amex Blue that is 19K and they havent threatened lawsuit yet. Both are at Zwicker. I have an amex/costco card too, and they are real quiet, no big fuss. I got a funny letter the other day from them, I have about 3500 reward points that I defaulted with the balance. They offered to re-activate my points if I pay the WHOLE balance of 19K. hahahahahahahahahaha..ouch, my sides hurt from laughing! Those points are worth next to nothing. Those computer generated letters make me roll my eyes. They also have offered an optima card if I paid the balance. Did you look on the back and read the terms of that card? High interest and also a yearly fee I believe. They aren't doing us any favors.

              It's really stumping me that they are suing you. You are about the same profile as me and I was not sued although I didn't pay them for a year. It sounds like we were even getting the same letters. My debt never was sold and NCO was the CA though. Strange.

                Who exactly is suing you? Is it AMEX FSB, AMEX Centurion Bank, or AMEX Travel Related Services? FSB tends to initiate more suits from the study of my local dockets.
                Also, was this a business card or a personal card?
                I was sued by FSB for a business line of credit, 5 times more than what you owe. Also, in my case, everything on the personal side was current which told them I had a money source to pay my other debts. They pounced quickly!
                I also never answered a call from AMEX or Nationwide Credit and cashed in all those points before defaulting. Funny thing is...they still send me my "Account at a Glance" every Fri. just to remind me of my balance.
                So who knows exactly what determines a suit, however I think Business debtors are a more likely target just from what I'm noticing on my dockets.

                    i'm in CA and haven't made a payment on my Amex since Jan/Feb of this year as well. I get nationwide credit calling constantly; and also receive my offer of a "optima" card if i pay my balance in full- what a deal! right? ..No? oh... lol
                    My balance is a lot lower; i think only $2500 and there hasn't been any threats of legal action. *knock on wood*

                    The funny thing is BOA- my husband defaulted on a card with them- balance of over $25k - they never even called us! We got a couple letters just saying we were late; and i think maybe one settlement offer (but i could be wrong). Haven't paid a full payment to them since December (made partials in Jan and Feb) and they just this month sold it to a collections.

                    First National Bank too- they sold to some type of collections; but they own the debt still. No suits; last payment Jan 2009.

                    I actually tried to make agreements with some of these guys a few months ago; i was worried i would lose my job if i filed so i was rushing for something. The only one that would do anything was First National. They are my largest card at 13k; and they offered a 0% interest for 5 years at $250 a month. I would have taken it if the other cards would have done something similar.

                      The optima card is personal, we don't have a business. I never talked to them, didn't answer the phone even once. If they checked our credit, they could see that we weren't paying any of our other cards either. We have paid our mortgage though. I haven't a clue why we were picked. Our atty asked the Zwicker atty for an extension on answering the suit while we are trying to get a car loan before we file bk. (not going too well with that) They gave us another 10 days. They know we are filing now, and a lawsuit is a waste of time. I just wonder if I had answered the phone before and told them our intentions if they would have still served us.

                      I have 2 BofA cards and they have been almost invisible. No calls, just the bills every month. They even took 3 months of no payment before raising my interest rate.

                        I am stumped on this one. I know that amex is being more aggressive in zipcodes with a high rate of mortgage defaults so maybe that is it?

                        I simply can't figure out why you are being singled out by amex here.

                              JDB is Junk Debt Buyer
                              CA is Collection Agency or California depending on context of the sentence.
