    Revoked Wage Assignment

    I am going to be filing Chapter 13 in a few weeks. I had a creditor that I got a small installment loan with over the internet and they attached a Wage Assignment to the documents. Well I stopped payments on the automatic payment from my checking account and I sent a letter certified mail return receipt revoking the wage assignment and inserted the law that says its only valid when signed in person. They received the letter and I got the return receipt stating they did. About a week later they sent me a letter saying they are going to send a letter of intent to my employer to garnish my wages with the wage assignment.
    Now how and why would they still send this letter even though I revoked it? What else do I need to do to stop this. Would it be against the law if they still tried to garnish with the wage assignment even though I revoked.

    I went through this exact same thing with an online payday loan lender. I had to inform my payroll dept of what was going on, and explained to them that I revoked the wage assignment and not to send this lender any money from my wages. Sure enough, my payroll dept called me in the office one day and told me they just received the wage assignment from the payday loan lender, but they did not send them any money. I would suggest you go to your payroll dept ASAP and explain to them what is going on because these type of lenders are very sneaky and they will attempt the wage assignment.

      I just sent them another letter stating the wage assignment was not going to be honored and I attached copies of the tracking information showing they received my first letter. I sent an email to our HR contact with all the info but she is vacation until Wednesday. I'm going to call my BK attorney this afternoon and inform him of what happened as well.

        I am so relieved, I got an email from our HR Rep and he informed me that our company does not honor Wage Assignments and everything must be court ordered. So hopefully nobody will try to sue me before I can get my papers filed three weeks.

          A lot of states require a court ordered writ and wage assignments are not court ordered. In fact, illegal garnishment of wages acted upon by your employer can cost the employer big time in many states.
