    Just got back

    Just got back from being out of town for a week. big stack of mail waiting. Found the following 2 fresh ones :

    both of these were citicards. i'll get the DV letters ready

      The latter turds you mention (United Recovery) are the ones who had all kinds of information about me available at their fingertips when they called...it caused me to stop paying my Exxon and Home Depot accounts I was so ticked off at Citi. (so why are you still paying your Exxon card? Good question. Now that you mention it, I'll stop.)

        I've dealt with them both. It seems like decades ago. Now one account is with a WA attorney firm. UNC is probably Chiti? It will most likely go back to the OC and then get farmed outone more time. No way to know.

        On another note, it is amazing how after 6-9 months the phone can get very quiet. Keep hanging in there if you need to.

            Your right about the phone. i'm at about 120 + says on most accounts now, calls have died way down, like an eery silence, except for Kohls who has a Human hammering away every day..

                I've had 2 phone calls from out of state in 3 weeks. One was Blind Mobile and the other, I don't know. When you call the phone number, it sounds like it is answered and then every 15 seconds or so you hear a click.

                I'm expecting the FedEx guy or the Post Office Lady to ring the doorbell. Still receiving CA and/or JDB form letters in the mail. That brings up a question. How do you know the difference between a CA or a JDB?

                  You can probably assume the debt has not been sold unless you check your credit report and see it is listed as status: Transferred. Otherwise CA's act the same regardless of who owns the debt. In many but not all cases, the JDB has a less than arm's length relationship with a law firm, and they hope to file suit and get a judgment, at least in the creditor-friendly states like NJ.

                    Thanks catleg. Waiting until the end of month to pull the other 2 Credit Bureaus reports (pulled Experian last Oct) on 8/31/09 as we will be filing Chapter 7 on 9/30/09.

                      Often times, not always, the dunning letter will show the original creditor, and it will show a "client," if the debt has been purchased.

                      For instance, many CA's collect for JDB's who purchased your debt form the OC. It is not always the case that the JDB sends you the dunning letter. You could get a dunning letter from a CA who has been assigned the debt from a JDB. LVNV (a JDB) (or whatever they are called) seems to do this as does CACH (another JDB.)

                      When you write your DV letter to dispute the debt, you should always ask for the full name and ADDRESS of original creditor. The FDCPA allows for this. Hell, if they intend to sue you, make them recognize your civil rights. And, keep good records. The FDCPA refers to the requirements that the collector (and a JDB is third-party) does have to furnish you with the name or address of the original creditor. The law seems pretty clear on this regardless of how many times the debt has been sold. Please correct me if I'm wrong.

                      By the way, it seems that this thread has been a great thread for everyone.

                        Here is an interesting little trick that works for Experian.
                        Once you get a copy of your credit report, you can enter the online dispute process and see the current state of accounts for free at anytime (just cancel out without making a dispute). You can also see who is pulling your credit. You just need a live report # within the past 90 days.
                        I've put a freeze on my credit file and this still works anyway (since the idea is to prevent anybody unauthorized from viewing..ironically the credit counselling guy tried to pull our credit to verify our identities...DENIED).
                        Variations on this theme work with Equifax and TU.
                        Note that the scummiest CA's do hard pulls on your credit...not that my score matters anymore. I've broken my chains.

                          Maybe calling on some help after printing our Credit Reports.

                          Catleg: Dh did have a dispute on his Experian last October. They had included his Son's student loan on Dh's report. Dh has a ParentPlus Loan for his son's first year of college. Let's see it was bought in 8/02 at $16,000 and it's down to $10,000 & supposedly at 4.125%. They have the same first and last name. Middle name is entirely different. They gave hubby 10 days a specific password for 10 days.

                          So now explain to me once again how I can get an Experian Credit Report for both of us without paying for it? as that is the one our BK Attorney has noted in his paperwork. O Hmmm, wonder if I could take a recent CA or JDB inquery and use that to request them? We haven't used our CCs since late last Sept. and dang sure haven't applied for credit LOL!

                          Maybe calling on one or all 3 of you for assistance about our credit reports before I turn all our Chapter 7 Bankruptcy information over to our Attorney early September. I've never wanted time to move on, but I want the next two months to fly by. I want that BK Case # so I can Blow It Up and tape it where all 5 phones are located.LOL!

                            Re: Experian, I order the paper credit report and re-use the file number as much as I need to.

                            Re: Freeze, my wife works for a financial services company, so I do not want them to run a credit check on her. Hoping the freeze accomplishes that.

                            BB: you're right, I think the accumulated knowledge of this board exceeds the vast majority of lawyers, judges, and people working in financial services jobs.
                            For example, your experience is priceless. If they were smart, they'd forgive your debts (as they are uncollectable anyway) and hire you as a consultant.

                              Really sucks being disabled so young. I'm 46 with parkinson's, just had brain surgery to implant DBS. Somehow thought with all your world experience you were older.
