    letting car go back

My wife is letting her car go back to the lein holder, it is only in her name, and after reopsession their will be a balance still due. If they get a judgement against her can my wages be garnished for the balance due? She has no job, I am the only wage owner.

Only if you cosigned for the loan, or you live in a community property state, or if your particular state's wage garnishment laws explicitly state that they can. If you have joint bank accounts, you could have those garnished possibly if they get a writ of garnishment for the said bank accounts, its possible.

Nope no cosign, not sure about community state. We live in Mississippi.

Mississippi is not a community property state, so it looks as though you are in the clear, congrats, comm. prop. states bite.

Just remember about the bank account thing, and my advice for you is to ask this same question to a reputable bankruptcy attorney in a free consultation, ask for a telephone consult.
