We are in California and going to file Ch. 7 but our attorney suggested waiting as long as possible (til possibly Oct/Nov) to file to get our income down to where it needs to be.
We were served a couple months ago. We answered the Summons and filed the answer with the court and were given a Case Management Hearing date of Aug. 20th. The actual trial date is in November and we will file before that.
Yes, we owe the money, although we did try to make arrangements once the attorney had been assigned to his office, but never got a response.
Anyways, since we are going to file and are paying our attorney's fees this Friday, but are not going to file til after this case mgmt hearing
a. Do we need to go, and
b. If we do go, what do we tell them? Does it matter what we tell them?
c. If we dont' go can they push the trial date to be sooner?
d. If we do go can we ask for a further delay of the trial? Not sure why we'd need to, but who knows?
