I agree with BB in that there are these "canned" letters out there on the web that I would guess are so preposterous some CA's will ignore them. When you start listing your own state laws, including annotations (numbers and dicvisions of the laws) I think you are more likely to get their attention. In particular, I am of the opinion that you don't waste a lot of time getting to the purpose of your letter. Be clear in the beginning, and you can save any of the additional stuff for later in the letter. Deny the debt! Ask for C&D if that is your purpose. Make it clear that telephone communication i sinconvenient. Ask for the "name and address" of original creditor (This cracks me up. No national CA has EVER sent me this.) But, it is clearly your right to know under the FDCPA.

The CV and C&D Letter I Use

I wrote a whole 9 pages of CV and C&D Letter, demanding every documentation containing my physical signature and all that. And I demanded personal information of the debt collector who will be contacting me. Without such information established first I will ignore all anonymous communications. And I made it very clear that if I choose to sue the collector, I sue the person, not the organization. And I made it very clear I am willing to only work with original creditor, and never any debt collector. I told then I do not want my debt to be disposed between owners like slave masters dispose their slaves, as the slave system has already been abolished.

I never get any phone call from the debt collector, and less than one month later they came back with a letter saying they have ceased further effort on my account. I guess my letter really scared the sh*t out of them.
