Being sued

Well it came quickly, too quickly! I am going to court tomorrow to answer a creditor that is sueing me. They are seeking a lien on my property. Luckily, I was not a signer on this account, so hubby will be doing the talking. He isn't nervous, wish I wasn't. Wish us luck.

that's the bad news, the good news is, I finally recieved my loan modification documents today!!! woohoo!! I will be able to file my bk in July.

Could you list who it is, the balance, and the date since you defaulted or made a last payment? Greatly appreciated!

Credit Union (is that wierd, I am afraid to list their name!)
balance $14k looking for a lien in the amount of $19,400 including fees, interest and costs.
The last time I made a payment was in September 2008.
CU hired a law firm in January.

I knew they were going to be aggressive from the start. I notified all my creditors of my intention of filing in Feb, everyone of them took my info and were very polite. Not this guy, he said well I am going to continue collection activity until you have a case number for me. He says lots of people say they are going to file and never do. Oh well, I had hoped to stall them but it was not enough time. My bk lawyer told me to ask the judge if he could delay the lien for 30 to 60 days.

Congrats on your Loan Mod! How long did you have to wait to get it modified/the paperwork? I've read that Mods are taking MONTHS to finally go through....

I originally contacted bank of america in January, was denied a couple times, approved on March 4th. I got the official documents for my second and third mortgages in April (also with BoA). It has been a long drawn out battle but well worth the effort.
