    UCB collections?

    Is it illegal for this company to act like they are lawyers, without ever saying they are?

    They call once a day and leave a message that is pretty clear that they are trying to give an impression that they are a law firm.

      Watch out these guys are scum bags. They love to call your neighbors and realatives (even after you have talked to them). I really have a special place in my heart for them.

        Record the message that is left on your answering machine if you can. I dealt with these folks in the past. Eventually they sent a letter and I DV'd them. They went away.

          In addition, if your accounts ever get sent to scum&scum law offices, they will often clearly state in a letter, "No attorney has personally reviewed this account. We encourage you to contact our office to make arrangements." Unless you have one of the finest attorney's in the country helping you out, you might have trouble fighting what you believe is an FDCPA or State debt collection violation. Some folks do manage to fight and win, but the details are beyond most lay-people. In addition, there are plenty of law firms that are in the debt collection business. They may be attorneys with the ability to sue, but they might easily argue that they are using their debt collection services. Just because you get a call from so-and-so from a law firm does not imply legal action is or will be taken against you. I discovered this when I contacted my state BAR association over a letter I received from an out-of-state law firm dunning me for a debt. Since no attorney "had reviewed the account," the BAR association told me they doubted any laws had been violated. In particular, I learned that my state excludes collection law firms from the state debt collection statutes. I still disagree, but I don't possibly have the resources (money) to hire an attorney to take on an out-of-state legal firm.

          If it were me, I'd give the caller a call and request written information related to the debt. Once received, send a DV and C&D. UCB went away after I did this.
