    Can you read this letter and tell me what you think?

    This letter is from the bank that financed our SUV, which was repoed and sold at sheriff's auction to the same bank that already owned it (?). It is on the bank's letter head, let's call it ABCBank.

    OK, here's the whole letter.

    Re: Account No. 12345

    Dear Mr.:

    Our records indicate that ABCBank has rendered a judgment against you for non payment on the above referenced loan. This judgment will be released as soon as the balance on the loan is paid in full. If this judgment is not paid in full, ABCBank reserves the right to reinscribe the judgment every ten years.

    I am willing to establish a monthly payment plan for you to dissolve this debt. Please telephone me at the number below so that we may set up an appointment for us to schedule a meeting to discuss the necessary arrangements for repayment of this debt. Please do so within 15 days to avoid additional legal action, garnishment, or charges against your account. If a response is not received by that time, this account could be turned over to the bank attorney to file a petition of garnishment against your wages.

    Your current principal balance as of the date of this letter is 17,276.25; please keep in mind this does not include interest, court cost, attorney fees or other charges.

    OK, here's my question. I asked my attorney about two months ago if a judgment could be filed without my knowledge and he said no. Papers would be served to me by the sheriff to notify me and I would have time to respond. So how could this be? This doesn't seem like a scare tactic, it seems as though they really filed a judgment. I have received NO papers of any type from anyone. My son is home during the day if they had tried to serve me. Last time they served papers for the repo done by the sheriff, the sheriff delivered them.

    I actually spoke to Ms. XYZ last week, well, she called and wanted my husband and I told her that I could help her but she said my name wasn't on the account and she couldn't talk to me and was really rude about it, then hung up.

    So can anybody shed some light on this? Thanks so much in advance.
    By the way, this letter came regular USPS mail.

    was there a docket number? or just an account number?
    The first sentance says "ABCbank has rendered a judgement against you" (not a court), also the line "do so within 15 days to avoid additional legal action, garnishment, or charges against your account ". Sounds like they are trying to scare you and that they have not taken it to court yet.

      No docket number, there is only an account number.

      If they're trying to scare me, they are succeeding! This is the first of the what seems like hundreds of letters that has actually made me nervous.

      Can they file a judgment without serving me?

        it would help if people would put their state (of residence) in their board profile, so we wouldn't have to keep asking:
