    How to Nail US Bank for FCRA violation?

    I got credit reports for my wife and I from Trans Union, and what do I discover, lo and behold, but US Bank, who is my creditor, but not hers, pulled account review inquiries on both of us. (she is not even an AU on the account I have with them).

    Any idea if I can nail them for violating FCRA? What should I do?
    filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

    Do you if it was a "soft" pull or a "hard" pull? (sorry, that sounds vaguely dirty...LOL)

    To do a "soft" credit inquiry I believe they don't need your permission as it does not affect your credit score.

    Even if it was a "hard" inquiry, I wouldn't be surprised if somewhere in all that creditor small print (in the agreement) it says that you agree to let them run a credit inquiry in case of default.

      No it's a soft inquiry, and they have no permissible purpose since they pulled my wife's credit. Nothing they can put in their contract can give them the legal right to pull someone else's credit report, even a spouse right? She is not an AU or joint account holder.

        If it's a soft inquiry they don't need permission...these are the same types of inquiries made by CC companies when they send you the "pre-approved" letters. (remember those days?)

        A CC company can run a soft inquiry on anyone without permission.

          Yep, those are marketing pulls. The creditors actually only get limited information. But those pulls are legit. Note, soft pulls DO NOT effect your credit score. In fact, according to the FAQ on most the the CRA's website, the consumer (you) is the only person that ever sees soft pulls on the CR. CR's provided to lenders do not contain a list of soft pulls.

            Yes but in this case it was listed as an Account Review, not a PRM. For a non customer of the bank, who just happens to be married and co-located with one of their deadbeat customers :-)

            I assume an Account Review shows them *everything* right?
