    Have you been sued by Chase? How long did it take?

    I really wish the wife and I never racked up a couple thousand bucks on a Chase account, as it seems this creditor just has no patience with anyone and just sues.

    So I am trying to see if I can get a poll going on how long did it take them to sue you, and did you tell them about your intent to file a BK.

    So have at it.

    Guess i'll find out. stopped paying a few weeks ago, and they are calling.

      I hear mixed stories about Chase, so it's like gambling. My only hope is that I can draw out the proceedings by answering to the complaint long enough to file by August/September. Local court website shows nothing at this point.

        I have three chase cards totaling about $25k. I have not made a payment on these since September. The interest rate went from 2.99% to 29.99% in one month but they have not tried to sue me yet. I did tell them we were planning on filing back in Feb but did not have a date and still don't.

          That's when we started to pay last too, the credit report shows 9/08. I suppose your case may differ from mine if your balances exceed that of which you can be sued in small claims versus civil.

            Yeah, that would make a difference. Do you have a lawyer yet? I spoke with mine about my concerns about being sued and he said not to worry, the courts in our area are so backed up it will take them at least 6 months to get a court date. That took a lot of the fear out of this situation.

              I do have a lawyer, and I dont know about the current court situation here, I am hopeful it is similar to your district, that would work out quite well.

                Ask your lawyer about it, he should have some insider info on this! I'll tell you it took a huge load off of my shoulders!

                    I have two cards w/ Chase (I only had one until Chase bought out WAMU )

                    Last payment on large account (around $16K) in December. I've been parceling out payments here and there to the smaller Chase/WAMU account (balance around $1600), b/c I actually can afford to make small payments on it and also hoping they won't take me to court on that one since it's so small.

                    Funny thing is, I talked to a Chase rep yesterday and made a small payment on the lower balance card. When he asked about the larger account and when I could make a payment on it (around $500, which I cannot do right now), I told him there was no way I could do that right now. He actually said, "Okay, I'll note that you said you cannot pay right now. Thank you and have a nice day." Kind of weird, but maybe I got lucky by answering his call instead of one of the other reps. Overall Chase hasn't been that bad to deal with though.

                    I don't know whether or not making payments on one Chase card over the other will raise a red flag, but it's obvious why I can pay something on the smaller balance card but not on the bigger one. We'll see what happens.

                      My ex was sued by Chase in our county's small claims court. He actually had 2 Chase accounts, one was a Master Card that he owed about $3K, the other a Circuit City/Chase card that he owed $2K on

                      It was the master card account that sued. It didn't take them long. He owed about $3000. The Circuit City/Chase card didn't file.

                      Last payment was made in Feb. 08 and they filed their complaint in June of 08.

                      He filed a CH 7 in October of 08 and...POOF the lawsuit was stopped dead in its tracks, dismissed.

                        My wife has been threatened with a suit, but nothing has happened yet. The debt is between 120-150 days late. I have also been threatened with a suit by a casino I owe markers to.

                        Everyone has to remember that you may routinely be threatened with a suit without actually being sued. It is a normal step in the "flow" of collections.

                        Generally threats to be sued must come from a lawyer, otherwise creditors can get in hot water under various laws. I think this is where the bottom 10% of law school graduates end up, hired by creditors just for the sake of putting their name on a collections letter threatening a suit. They probably sit in an office drinking coffee and playing sudoko or something, where they can't do any damage.

                          How did you respond to the threat of the lawsuit? I am just going to tell them to call my attorney and nothing more, if they wanna sue, so be it I guess. I will atleast answer the complaint to delay it by a small amount of time, because according to the sticky, if I answer, they have to file a MSJ, and there must be a hearing for it. So to that end, it will still delay the process nonetheless.

                            I am debating this question right now (how to respond).

                            My normal policy is not to take creditor phone calls but it occurs that at some point I should make my case for them to go away.

                            All things being equal I would still prefer not to be sued, and I can't be certain if they will go away or not. I am not yet represented by a lawyer.

                            I have some medical issues with a prescription drug I took which I believe gives me a decent shot at an "incapacity to contract" defense.

                            The complication is how I will handle the accounts in my wife's name.

                              What happened to Big Boy? How do you make a comment "depends on how you answer" and then not explain it? Anyone see him...have him come back and finish his post.

                              Talked to my good buddies at chase yesterday. One lady 4-5 answerd calls ago came up with a plan (that I actually considered) of $550 a month (my chase bills are like$1,100 usually) for a year and go from there. I ultimately passed on it because of seriously considering 7.

                              So since then NONE of the chase people could match that offer...so I kept using it as a "If you will accept $500 a month for year I'll do it"...I figured like OPT I'd buy some time. They all came in at $900 for 5 years. Yep...sign me up.

                              At any rate the guy yesterday came in at $600 for 12 months. Oops. It's not $500, but it is one I need to respond too. Quite frankly I am trying to settle before filing...but I need this come to a head in December/January (filing 7 or not) so I need my Credit Card companies to hang out with me and not sue me till then. Is it possible?

                              Last payments to credit cards...going on four months now. I figure I have two more before they move it to a CA...after that...I don't know how long I have.

                              Have not been threatened with a suit from them...yet. They've actually been pretty nice...the 2nd...they've been jerks.
