I just hung up with Ali from American Express. He called and stated he was from American Express and he would like to make me a settlement offer. He offered to settle an 18K balance for 8K. I was very polite, told him I was not in a position to accept the settlement offer and then gave him my lawyer info.
He asked if we were filing BK, I said that we were very sad about it, but yes we were. He then told me, and this is the part I can't believe, that he wanted me to be aware that IF (he stressed this word hard) my bankruptcy would be approved, that I would be required to pay every person on my credit report at least ten percent of what I owed. He went on to say I am prepared to offer you a much lower settlement than the one I previously offered and you would be much better off settling than trying to file BK.
At this point, I said that's very interesting. I am also turning on my recorder because I want to make sure that I understand what you are trying to say.
I am not aware of this, can you explain. He says, what do you mean. I say, the part about being required to pay everyone I owe a certain percent. He says, well that's what I thought. I told him that's not what you said, don't you think if you work for a collection agency, you should be sure of what you tell people?
He then says, well we have your lawyer's information, we'll be contacting him. I tell him, I think you should discuss the FDCPA guidelines with him while you have him on the phone so that he can explain the 1000.00 penalty each time you threaten someone. Then I asked him for his employee ID number. He refused to give it to me.
Then he hung up on me. At no time was I rude, loud or angry. I spoke to him in a calm and reasonable voice.
So how bad does he suck? These people are horrible. I understand if it's your job, but don't lie to people to coerce them into an agreement that they won't be able to follow through on.
