    Call from American Express, unbelievable!

    I just hung up with Ali from American Express. He called and stated he was from American Express and he would like to make me a settlement offer. He offered to settle an 18K balance for 8K. I was very polite, told him I was not in a position to accept the settlement offer and then gave him my lawyer info.

    He asked if we were filing BK, I said that we were very sad about it, but yes we were. He then told me, and this is the part I can't believe, that he wanted me to be aware that IF (he stressed this word hard) my bankruptcy would be approved, that I would be required to pay every person on my credit report at least ten percent of what I owed. He went on to say I am prepared to offer you a much lower settlement than the one I previously offered and you would be much better off settling than trying to file BK.

    At this point, I said that's very interesting. I am also turning on my recorder because I want to make sure that I understand what you are trying to say.
    I am not aware of this, can you explain. He says, what do you mean. I say, the part about being required to pay everyone I owe a certain percent. He says, well that's what I thought. I told him that's not what you said, don't you think if you work for a collection agency, you should be sure of what you tell people?

    He then says, well we have your lawyer's information, we'll be contacting him. I tell him, I think you should discuss the FDCPA guidelines with him while you have him on the phone so that he can explain the 1000.00 penalty each time you threaten someone. Then I asked him for his employee ID number. He refused to give it to me.

    Then he hung up on me. At no time was I rude, loud or angry. I spoke to him in a calm and reasonable voice.

    So how bad does he suck? These people are horrible. I understand if it's your job, but don't lie to people to coerce them into an agreement that they won't be able to follow through on.

    Any thoughts?

    You're awesome. If everyone handled collection calls in the manner you did, if intimidation and lies didn't work, then that tactic would stop. Since suing your creditor isn't a practical remedy, consumer education may be the only effective remedy.

      You handled Amex exactly right. It is amazing what the collections agents say they think they have you over a barrel.

        Yep, never lose your calm. Well, sometimes its okay if you know you are in the Captain's seat. Given all the FDCPA violations that occur, one could put a few CA's out of business, but the time and cost to the consumer does not always pan out. You could do other folks a favor by sending a note to the FTC and file a complaint. Your voice only adds to the potentially thousands of other voices. Every drop of rain counts in the end.

          Yep, you do everything by the book...and still...they are rude.

          When I told my mortgage company that I filed BK and gave them the info, they still asked why I couldn't make the payment...Hello? Are you stupid?

          I'm currently dealing with an HOA's attorney for post-filing assessments, and they have done nothing but lie lie lie. As my mom says, anyone in collections is just one level below an ambulance chaser.

            Thats funny, a guy from American Express named Ali called me a week ago and tried the same gig. I owe like 1800.00 (its like the lowest card I have) and said he would settle for 650.00 I told him I needed to speak with me Lawyer and he went into the same story.

                The next time they call you just tell them you were laid off from your job at AMEX,you used to be a collections agent and you're job was outsourced to a company in India and now you don't have a means to pay anymore.

                    I pulled my Amex letters and the last collection one was from James A West, which is strange, because the CA definitely had a strong Indian accent and there was alot of background noise and the other people I could hear had the same accent, so it must be one of the outsourced ones.

                    He did not identify himself as a collection agency, he just said he was calling about my American Express account. DUH, I should have asked him that.

                    The letter from James A West is dated 1/27/09. A month before that, I had a letter from United Recovery Systems. So probably its gone from James A West to somebody new, and I haven't received anything in the mail from them yet.

                    overmylimit, that's a huge coincidence that we got the same guy with the same tactics. How many people do you think that he is terrifying right now that just don't know any better?

                      It's probably not the same guy. How many people do think they have named Ali (all the names these collectors use are fake anyway)!

                          If it came from India Ali is probably as common over there as is Bob or Tom is over here.

                            In my state we had to record a false name affidavit to do this. The work around was to use a variation of your name (no paper work)

                            Most people just used their Last name first followed by their Middle name.
