    i might have jumped a bit too quickly when i retained this lawyer... hes young and seemed to be eager... now hes tardy on answering my emails... hes also been paid already....except for the filing fee, that is..

    i went to see another one first, but his paralegal didnt even know that SS was not included on the means test...but then the first one didnt tell me to get rid of my motorcycle either...

    gawd, i hope that im not going to have to cut my losses and go looking for another lawyer....

    i never realized that in a thirteen a lawyer gets his cut first... no wonder he told me to pay a few payments and quit.

      Did you pay this attorney' entire fee up front?

        I saw a BK lawyer for a 1/2 hour and paid nothing. If they want to charge you for a consultation then I would pass on them. Everything I have read on hear the lawyer has been dead on about so when the time comes he will be getting paid.

          alas, ive already paid most of his fee... initially i was impressed with him... now, not so much! it also states that his fee is not refundable on the reciept.

            No sense letting it go to waste, now just tell him exactly what you want to do and have him execute it, namely file a ch7. If he refuses then he should refund the fee. He's probably lazy and just wants cookie cutter cases. Yours should be pretty simple, worst case is you have to pay some money out of your future income to compensate the "estate" for the equity you have in the bike.
            filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

              Do you have other debt? Other than the $7500 for the repoed harley (there should be a law against taking a man's bike)

                  Floridian - I would not use your attorney. Do as BB2U suggests - if he won't refund your money, report him to the bar.

                  Having a good attorney is essential - it is the difference between a clean start and a mess. JMO.
