Well, on Friday, I'll attend my first small claims hearing for a case brought against me a collection agency. I have a couple of counter claims related to my state's debt collection practices act. I've heard that the local judges and some mediators are hard on debtors, but it will be interesting to see how they respond to the laws they are expected to work within.
I received a confirmation of hearing and the collection agency lists one of the debts under a company/name I have never heard of, and I'm damn sure there is no contract that has my signature on a paper listing the name of the company the collector has listed. I believe what happened is that the original creditor/company was perhaps purchased by the new creditor; however, I was never informed of this. As far as I can tell, the CA probably has no documentation that directly links my signature to the company they are hoping to collect for.
