    Sprint

    Sprint keeps sending me bills. They were on my petition and I know they've received the bk paperwork by now.

    What should I do?

        Send them (or have your attorney) send them a c&d letter. Let them know you're in BK and to stopp sending you statements.

          Here's the important question - does the bill Sprint is trying to collect contain any charges from using the phone AFTER you filed?

          If it does, then you are responsible to pay any portion of the bill that you incurred AFTER you filed and Sprint has every right to ask for THAT PORTION of the bill to be paid.

          If you never used the phone for even one minute after you filed, then Sprint is violating the automatic stay. Notify your lawyer.

          07/18/06 - Confirmation Hearing - not confirmed, 3 objections

          09/27/07 - Confirmed at last!
          06/10/11 - Trustee confirms all payments made
          08/10/11 - DISCHARGED !

          10/02/11 - CASE CLOSED
          Countdown: 60 months paid, 0 months to go

            The phone was turned off in Jan - so no I did not use it after I filed. I haven't got a lawyer, filed pro-se. Can someone point me in the direction of a C&D for violating the automatic stay?

              I've been writing my own, since I don't know of any formal form posted here, but I just write:

              Creditor Name
              Creditor Address



              Acct#:


              Date:

              Notice is given that (your name, address) is in an active Ch 7 Bk filed <date>

              Cease any collection actions regarding this account.

              US Bankruptcy Court
              Address
              Case #


              Attorney: (name, address)


              I haven't heard from anyone since.

              But somebody might have a better way.

                Hmm, Send them your case number and an informal complaint that they are violating the automatic stay. You might want to send this return-receipt registered US mail.
