Received new CC from creditor we have not paid in 4 months

Got a new credit card today from a credit card company we have not paid in four months. We owe them over $8000.00 and the new card is for $8000.00. The existing account we have with them has already been closed. They also included a blank check in case we want to do a transfer or whatever.

I suspect this is a trick. The card has to be activated and when we go to activate it, we probably will be sent to collections. And if we use the check, we can only imagine what can of worms that would bring upon us.

    We have not filed yet.

My first gut reaction is to call them up and CLOSE it! Do not use that 800 number to activate it.

Suspicious that the credit limit is for the same exact amount.....

And the trick is that yes, the old card was included in BK, but because this is a new one, any charges you rack up and don't pay, they can and will go after you for.(Not protected by the BK)

by activation, BJ (oh I mean, Big John), you could institute a new time line and cause your action to mess up the stay. 'Hub

Exactly.....so don't bother to open it, and when you do file, make sure the 1st card is included in the BK.

Does the card that they sent you have the same account # as the old one?? If so it is just a replacement card for a card that is no longer valid after a certain date. Do not activate it.

I also think is a trick even if the acct 3 is different.

If the old account has been closed, I doubt it would have the same #.

Methinks they are trying to reset the clock for collection purposes.

I agree that it's a trick. I got a few cc convenience checks before I filed which I thought was insane. I just ripped them up and tossed them.

The new card has a different account number.

When the wife saw the card, she lit up like a Christmas tree. I explained to her we can't use. She understood.

Same thing happened to us after we filed bankruptcy. Our Discover card expired in april and Discover made sure to send us out a new card. LOL I just shredded it.

Got a letter from Sam's Club Discover yesterday. New account, new account numbers. Included with the bill was a 'thank you' for opening up a new account and the Sam's Club membership already was deducted.

Because I don't take the calls, I got a feeling they are trying some new scam trying to get me to contact them.

So far, creditors have been pretty nice. We are in our 4th month of not paying credit cards and so far, nobody has done anything.

We are in our 6 month of not paying and haven't filed yet, no one has done anything much anyway, (knocking wood). Got a few collection letters, calls in the beginning, those stopped with lawyers name and number. We still get credit card offers almost everyday and so far all accts other then small ones are still open and sending statements every month. We get convience checks, throw those out. We have one card cancelled, Discover, no balance, never used, never even activated.

Each and every credit card application almost makes me laugh, how dare they send me those things, I don't want them, I don't even want a cc in this house. Much as I would love to stick them with some huge amount of debt to file on, I am a law abiding person and would never commit fraud.

My advice is DO NOT activate anything while knowing you're headed to a BK. Don't give those cc companies any reason to object to your BK, and it sounds like your wife needs to look on this forum about what cc companies are capable of, she wouldn't even think about using a cc at this point in your lives.

I received some "guaranteed" consolidation-type loans from defaulted CC's a year or so ago. I figured that they just wanted all the information they could get. I never received a new account. I have heard of this, however.

If you had a long credit history and always paid on time, I suppose creditors might make one last effort to get you into a new consolidation account with reduced interest so they could get payments. But, to give one a new card and new line of credit not tied to consolidation/balance transfer sounds a bit strange.
