    Chase called me 7 straight times yesterday within a few minutes. I of course let it go to voicemail.

    I guess they figure that harassment at some point will force me to pay something to them.
    Very fortunate in the grand scheme of things but have learned my lesson.

          I know they are not supposed to call anyone but you once they have your correct phone number & address but the point is that they have been calling my moms work. I believe this is because I have not picked up any calls for a few weeks.

          In my case, I believe I need to pick up calls every once in awhile.

          Meanwhile, I am calling all my credit card companies & making sure they only call my cell & have my correct mailing address.

            I don't want to be sued faster by writing these letters. Is that the case or should I start writing out these letters?

            I am going to research this a little more meanwhile I had a few questions maybe someone can help me with.

            Where do I send these letters to? Credit card companies? Do I need to call for an address? Do I need to write more letters to other collection agencies later when debt is transferred? Send certified mail?

              Regardless if you send a letter or tell them over the phone that you're planning to file bankruptcy, both could speed up a lawsuit.

              We were advised not to say a word until the paperwork was filed.

                The simple truth is your attorney tells you not to say anything that "might" trigger a lawsuit because its more work for them if one is started. But your filing stops any lawsuits dead in its tracks. Further more any lawsuit that results in a judgment can be offset by your attorney after discharge.

                If you tell ABC collections to piss off, that does not mean it will result in a lawsuit. If you tell XYZ creditor to piss off, that also does not mean your going to be sued.

                You can speculate all day long on what you can or can't or should and shouldn't do to get sued but frankly, you won't know what is going to happen until it happens.
                Exactly....why make more work for yourself and your attorney? A cut and dry bankruptcy sounds just dandy to me.

                    I will be filing in 2 years.

                    BigBoy2U - I get what you mean. Reading all these threads on here, some people get sued quickly, some don't get sued at all, etc. There is certainly no set way to say something will get you sued faster but hearing others experiences helps me form my own opinions & alleviates some fears.

                      yeah, well, for what it's worth, the only creditor who has sued me and just gotten a judgement is HBSC. That also happens to be the only creditor I did not take calls from and sent a cease and desist to early on. Because of the cease and desist, the collection agency refused to talked to me when I tried to inform them of my BK.

                      I don't think there is any way to know with certainty what one creditor or another will do, but I do believe that if I had talked to HBSC in the first place, I would not have been sued.

                      Just my two meager devalued american cents.

                          When it comes to sueing, there are robably a lot of factors. As much as people use computers, I got a feeling computers are not used much in this decision making process. I got a feeling a lot of it is gut feelings. Some of the things they probably look at is:

                          1. Where a person lives. (value of homes, and how many are in foreclosure etc.)
                          2. Type of work the person does - stability of employment
                          3. How much equity is in the home, car(s), etc.
                          4. Age of debtor.
                          5. Health of debtor.

                            I just ignored mine. I had about $170K in unsecured credit card debt from a failed business. I stopped charging/paying in Dec 07 and filed Ch 7 on Jun 08, and knew that none of them would sue me in 6 months. The calls were probably worst from Chase and AMEX, Capital One moved to collections agency quickly. I had my cell phone programmed to not ring when their numbers called and would constantly be adding new numbers to my "not ring" section (WONDERFUL feature on a caller ID cell phone). Towards the last month before filing it was about 30 calls a day, starting promptly at 8:01 am and going till 9 pm, 7 days a week. I could just check my call log and see how times they called because I never would hear the rings or see them unless I actually checked the log. It all stopped 2 weeks after filing. My phone may go through a WHOLE day now without even ringing.....
                            6/11/08 - Filed Ch. 7, Filed Pro Se, No-Assets
                            7/15/08 - 341 Meeting Held
                            10/01/08 - Discharged
                            10/08/08 - Case officially Closed!!

                              Amex and Chase are the worst.

                                There's been a lot in the news about the "latest thing" in debt collection is Zombie collectors. Well, OK, they're trying to collect zombie debts Debts from eons ago.

                                I've personally seen CA's (recently) go after my ex for a $300 utility bill from 1989! Funny thing is, it wasn't on his credit report when I paid off all his debts in 2005 (long story, don't ask). They must have figured he came into some money and decided to get whatever he could.
