    Capital One/Providian

    These are the two companies I owe. Has anyone dealt with either one and how was it? Also has anyone been through or know how wage garnishments work in Tennessee? I have looked on the Fair Debt Collections act site and read the explanation, but didn't understand it.

    The percent of wages that can be garnished is state specific and you should be able to find it via google.

      I filed a chapter 7 last year and Capital One was one of my debts. I never heard from them again once I got the automatic stay one receives when they file bankruptcy. I checked my credit reports and they stopped reporting on it. All my other accounts say closed due to bankruptcy...all except that one. I checked Pacer and they received the information that I filed, they did not object even though I owed them 8000.00 and the bankruptcy was dismissed and closed last year due to NO ASSETS.

        In my personal experience, Cap1 only assigns debt for collections. It does not sell its accounts. However, the assigned collector can certainly make use of all legal options they have. If you ask the question in 30 - 60 days, I'll be more knowledgeable...LOL
