    Interesting message

    just recieved today the number called from was 500 000 0000.

    The lady said she was calling in regards to a case number on me for the client she represented no mention of who and wanted to speak to me or my counsul only in regards to litigation against me.

    I called the number she provided and it is Creditors Interchange. I havent recieved any letters from them regarding the account they have or any summons to appear in court. not sure if she is just playing lawyer on the phone or what.

    But thought it odd I havent recieved anything in the mail from them. I havent spoken to a single creditor since I stopped paying in August and have lived at the same address for 10 years now.

    Has anyone had any expiernce with them ? I'm hoping to hold of filing until March Aprell if I can so I have a year and some months between any charges and cash advances. Thanks in advance.

    She did sound more authoritive than the Mike Jones who calls playing attorney on the phone for his client everday. I kind of felt sad for him last nights message he sounded depressed and not his usual gruff self. made me want to call him back and to ask him if he is doing alright.

    Just ignore them. Talking to them is not going to delay anything. March and April are just around the corner, if they sued you TODAY, they would be lucky to have a judgment against you by mid-April. (unless they sue in small claims court, in which case, probably end of march).

      Small claims is a less than $x amount case right (depending on state, like 500 or 750)?

        Yeah, it depends on the area. I'm not sure whether it's states our counties that create the limits. For the district court that has jurisdiction over where I lieve, the limit is up to $3,000.

        Do yourself a favor. Check everything I say with a bankruptcy attorney. Most attorneys will even provide a free initial consultation. In fact, it's your life, so check everything anyone says (including your attorney) for yourself!

          Its $3000 where I live. Interesting thing is that I believe where I live if you had a small claims case against you, and it was on one of those debts folks often "secure" with "household furnishings," they cannot come for the household furnishings because the small claims agreement is a "monetary award" only. I'll have to check into this more carefully, but several solid references have told me that in my state small claims can lead to a judgment but not a lien. Oregon also has several (3 - 5) different types of judgments, as I read the statutues. I think they attempted to clean up the statutes a few years ago, but don't know if they succeeded. Perhaps this refers to the "small" in small claims. I now know several folks who have been sued and had judgments in small claims here, and it does appear that the prevailing party can only go after wages and/or bank accounts.

          Anyone else ever heard of this, or have any comments as to why this could be the case?
