    repossessions

Can a person who does repo work come inwhere you work show you a paper that he is going to repo your car? I know my car might be repo as my attorney said don't worry about it. So i knew i owed money, but the company never sent any letters on payments or they were going to repo the car. So last 12/4/07 at work i with working with co-workers and this guy and his son came over showed me this paper and were to take my car away while we were working, can this be legal to come in a work area. Some people call thsi harrassment is this true. Can the repo guy/co be sued? I know someone who sued and won.

    thanks,lj

    Probably nothing illegal about it.
Repo guys can take a car from where ever they find it.
They just cannot go into things like locked garages.
If it's in plain view, it's pretty much fair game.

At least he was nice enough to let you know.
I've heard of people coming out of the grocery store only to find their car gone from the parking lot.

I concur, I do not think it is illegal. Your place of employment is not some sphere of privacy.

Actually awfully nice of him to come inside and tell you so that you can get anything you need to out of the car and aren't surprised when you find it missing.

True, that was "nice" of the repo goon to come inside and tell him about it, but if the repo goon had not, and just towed the car, he could have filed a police report/stolen car report.

            repossesions

So it is legal to go a place of work and hand someone paper saying they are taking your vechicle? I thought some businesses don't like harrassment. Mine does not like anyone bothering their employees. So that's why i wanted to ask. lj

              Wouldn't have mattered.
The repo man has the legal right to reposess the property.

Yep they do all types of things to repo cars. If your job had private parking and he got in somehow and repo'd the car still the actually owner of the car told them to repo it,, and
sorry but even if you didnt get a bill saying your carnote was due you had to know you didnt pay your bill.
Honestly I am quite surprise the repo guy was nice a enough to show a piece of paper to anyone that he was repo'ing your car.. in most situation you'll come out with a handful of stuff to load in car and car is gone and you think the car company cares about your job evem if your job called the police and make him leave the property he would have waited until you went to the mall or something and grabbed it.. Once car is out for repo its not yours anymore..

Depending on your state, and if that statement is true, the actions could have been illegal. In many states you have to be notified 10 days in advance of any repo activity. Typically, you receive a notice in the mail telling you that you have 10 days to pay off the note (NOT just make up the past due amount) and if not, they can take it. IF the creditor scares you enough that you do come up with the past due amount, they will generally back off. They rather have $$ than some old clunker. BUT once they have sent you the "notice to repo" they don't have to give you another notice if you fall behind again. They can just come and grab it.

Coming into your place of employement is legal. However they would have to leave if asked. If they can walk in just like anyone else and ask for you then I don't think anything could have been done.

Your employer had the right to ask them to leave just like they have the right to ask anyone else to leave.

I agree with the previous posters that it was actually a courtesy to come in let you know. Most times they just tow it off without any notice.

You said that they never notified you? did they call when you were late? Did you have communication with them regarding your past due balance? did they have your correct number, etc.?

My Company Does Not allow repos to enter property with or with out letter unless it is accompanied by a sheriff.

Also They will NOT allow process servers on site unless again a sheriff is present.
