    Writ of execution

    When a writ of execution is filed and served, am I correct in understanding that it is for one-time use only? That is, the creditor must get another writ from the Court to collect additional monies? I had a bank levy on my account - can they go in again or must they file again?

    It depends on your state.

        The judgment gives them the right to execute...thus, in most states, you only need 1 writ of execution...but you have to go through the whole execution process each time you want to hit a bank account.

          There were enormous fees paid to the County - about 5%. Do they hit you with that every time? How do you get a payment plan set up with these people? I fwrote a letter claiming exemptions.
          What's unbelievable about this is now the sheriff and county gets big fees but that 30% interest the credit card company was charging becuase I was late on another card is now much lower due to the law....

            Yes, to execute, they have to pay the fees everytime.

            Why not just delcare BK already and be done with it?

              Or at the very least stop putting money into any bank acct!

                HHM - I spoke with an attorney yesterday who advised me that he sheriff can go back to the bank again but I will not be hit again for sheriff's fees.

                  Yeah! Why in the world are you still making deposits to that account after this happened?! You might as well ring the dinner bell. Everything you put in there will be seized by the creditor until they are paid off.

                  Learn to start using cash and money orders to pay for everything until you can file BK.

                    DITTO. CASH AND MONEY ORDERS. Forget your bank - stay away from them.

                    it's actually kind of fun using cash - especially when small stores cannot cash your $100 bill. makes us feel powerful
                    and there is always that allure that you might be "connected"

                    but sometimes they look at you funny when using all cash, especially on larger purchases...but it's kind of fun.... people stare...
                    (like cash is really extinct)

                    Money Orders are a pain in the neck - Just try and plan maybe 2 visits to the Post Office a month (gather all bills with your cash and go to the post office and try to do it all in one go)

                      You can get MO's from Walmart at 1/3 of the price the post office charges.
