...They finally thought to call at 8:00 & not 6:30 so I answered (Survivor was just starting). Isn't there a time frame to not call??? Anyway, the lady (I'll be nice) was asking all the typical question & saying the typical stuff like "you work you can pay" stuff. Like not - I have to pay alot in childcare due to the fact that I do work "and" I'm a single parent, I have to feed & clothe my child. I have to buy gas to get to & fro work. I have to pay rent & utilities. I lost almost $300 in disposable income from my divorce, & she thinks I should pay her & no one else. I "advised" her I can't pick & choose one particular creditor to pay, & that my lawyer advised that the trustee wouldn't agree with me paying one creditor over another. She kept saying "oh they'll say that". She thinks I'm stupid. Arrrrrrgggghhhh!!! She was threatening to that if they pursue legal action they can garnish my wages. I "advised" her I would be filing in less than a month. Like they can get though the whole court system & garnish my wages before I get my court papers filed. She was starting to get "$#!&*%". I told her that she would have to take it up with my lawyer because unfortunately I could not give her a payment, & she wouldn't shut up & I advised her I would disconnect. Finally she hung up on me. This was my first nasty call. Realllly Realllllly Realllllllly pissed me off. Just for peace of mind. I know they haven't taken any legal action yet. When I file withing the month, will they have gotten anywhere if they were to pursue legal action starting tomorrow??? Wish this Zanax would kick in. I'm soo stressed! I needs words of support!!! Anyone???? Why did I pick up that stupid phone!!

Relax there! Assuming they were n court tomorrow to file against you, it will take a good while to actually appear before a judge. First, they have to file, then get notices to everybody. When you get served with the notice, don't freak - it will tell you that you have xx days to respond, so wait until the day before the deadline, and respond with enough crap that will take several more weeks before a court date is set - then, it's usually several more weeks or a month before it gets a date set. You can always file a motion for continuance to extend even further (easy to find reasons why) - but by this time you will hopefully have filed and this bee-ahtch and her friends won't have a chance to get anything.

you aiiiright ! one of my creditors even told me that I couldn't file BK because I had just opened my account! i had that account open in late december and filed in late july .. little did she know ! that debt has been discharged !

Hey.
Don't let these people get to you.
For me the calls are nothing more than an annoyance (because I just hate the sound of the phone ringing)
And they can even be therapudic.
Generally I will pick up the phone and say hello.
Usually if it is a bill collector there will be a delay (as they are using automated dialing and wait until they have a person before they pick up their phone)
I have a couple of options there.
Hang up imediately. (usually when I don't want to bother)
Just set the phone down and let the talk to the seat of the chair next to me until they hang up (slightly amusing at times)
Or if I am feeling mischevious, I will wait for them to repeatedly ask for me several times then respond with something like "How does it feel to have to wait for someone to come to the phone. Bet you don't like it either."
Then hang up.
When I am feeling really frisky, or if I am in a bad mood and want to vent a little. I will actually wait for someone to come on the line (even with those calls that start with an automated message about them having an important phone call for me but all their operators are busy)
Then when they do, almost every time they are someone with a horrible accent and obviously not from this country. My responce to whatever they say is "Are you a US citizen?" They are usually surprised by this question and ask me what I just asked. Which I then repeat the question. Usually they will try to push past that question by either ignoring it or saying something like that doesn't matter.
Which then gets the responce.
"It does matter. I am a US citizen. I live in the USA. I only do business with people from the USA. Have whatever company is trying to contact me have a US citizen call next time."
Sometimes that is the end.
Other times they feel the need to keep right on trying. Which if I am really being evil will get them a long string of words and phrases that I can't type here.
I even had one reply to the US citizen question with.
"Hey, I am tired of this @#!t. I have called before and you gave me this crap.
Then he went off on a string of explatives and hung up on me.
Never did find out what company he was calling for though.
It my little way of fighting all the outsoucing that companies are doing these days.
So instead of letting them get to you.

Don't let it stress you out. Thats what they want! They want to scare you into paying. I had a creditor who gave me date and told me if they did'nt have XX amount in thier office by noon on that date they would sue me and garnish my wages. I filed 2 months after that date and they never sued.
I did'nt talk with CA very often but when I would pick up the phone and it was a foriegner(sp?) I would say, I can't understand what your saying, if you have something to say to me have someone call who speaks English, and then hang up.chap 7 discharge 06/07
