    Trying to repo my car! Please help!

    I live in Illinois and I have a leased car that is 90 days passed due. I'm very close to having the $$ to catch up to it thanks to my new job, but b/c of some financial hardship I cannot let the company take my car back. Due to a combo of my horrible credit and the potential repo on my credit report, no lender will touch me if my car get's repo'd. I have bee concealing my car in another parking lot but I have heard in some states this is a felony. I do not want to get in trouble but am really at a loss as to what my options are or what I can do here.

    Any advice would be greatly appreciated!

    p.s. Repo guy called me 2 days ago at 11:30 at night and told me he was there to collect the car. I told him that's not happening and he started to threaten my with things such as "I will report it to the police". I did not tell him I was filing for Chapter 7 either. Although my petition has been drafted I have not "filed" yet as my court costs are upward of 1700 bucks.

    Again any help would be appreciated!

    Have you contacted the company holding the lease, and explained your situation to them? If not, do so immediately............if your past payments have been on time, they'd rather work with you, then repo the vehicle.

      Oh yeah numerous times. They have told me flat out my efforts are not good enough because the payments are so far past due. I'm not concerned with them b/c I WILL pay them ASAP as soon as my new job starts paying me. I'm more concerned with the legal ramifications of hiding the vehicle from them.

      Is all this felony for concealment mumbo jumbo real? I don't wanna have the police come knocking at my door....

        I'm not familiar with your states repo law, but typically if you hide your vehicle from repo action, and are more than 90 days past due, the lien holder can contact the authorities for assistance, in recovering the vehicle.

        Have you at least made good faith payments?

          Yes I have, but I've completely run out of money. I will be able to make payments probably in the next 3 weeks so I hope I can hold out, as I am now 90 days past due...

            A BK wont even help you in keeping your vehicle because you're three months behind. If when you get current, the lien holder, may still wish to recover the vehicle!

                Repo men are right up there with JDB's in my book. In some states such as mine, concealing the vehicle is illegal. However, they do have to prove you are hiding the vehicle. Being hard to find helps. When someone knocks on my door at 2:00 AM, I'm not answering. If someone calls my phone number from any unknown number in the middle of the night? They are getting voice mail.

                It's just like being served, nothing says that you have to be easy to find.

                  Most states except the state I live in, Georgia, you have to get a writ of replevin. This will allow the repo guys to get the sheriff to force you to produce the car or then risk contempt charges.

                  But as Bell said they have to 1st get the writ and then get a hold of you to serve it on you. Making yourself hard to find can buy you a week or so as well.

                  BK could delay it as they would have to file a motion for relief of stay which will take at least a few weeks, but unless you have other debts I would not BK just because of a past due car payment.

                  4/1/09- 341 Hearing: 1 creditor showed up Got to love family feuds
                  4/2/09- Trustee Report of No Distribution Filed
                  6/24/09- Discharged and case closed
