you are in no position to demand anything, once it is on your
credit report, it will be for a very long time. as for the $100 court
fee they assesed, more then likely they have already paid this
fee, maybe even more to the court, so weather you show up
to court or not, does not matter, they have paid the fee and
they are passing it to you. the fact is, they are taking you to
court for a judgement, if they win, they will do whatever it takes
to collect, even if it means taking it from your paycheck or bankaccount.

they are the scum of the earth in town here - and the judge knows it.

are you related to the judge, does he personally owe you a favor,
so therefore you assume on what he is going to do...

to be honest, it sounds very much like a judgement is coming
your way, and you are just not willing to face it, the only way
out of this judgement is to pay the FULL amount of what they
want, this is the only way your judgement will be dismissed...

and the judge will not care about your attitude with the creditor
nor will he care about the $100 you are going to gripe about.

You will pay what they want, or you will get a judgement.

What you keep missing in my posts is that I am not going to have to have my wages garnished or anything else - I will pay it as soon as I get a judgement and as part of that judgement the judge will put a stipulation in there that the debt place has to report to all three credit bureaus that this debt has been paid. I deserve my day in court and as my attorny said and another one confirmed, if there is a slight chance that the attorney will approach me before we go into court with a reduced offer then I will do that - either way it will be done and over with tomorrow around 10.

I have a question....did you INCUR (date of service or purchase) before or after you filed and before or after you discharged? I read all of the posts, but didn't seem to see that?

My uncle failed to give them a written notice explaining exactly why they were not getting their deposit back, and so the renter prevailed in small claims court. That very same day the renter's attorney friend garnished my uncle's checking account and drained the whole account. [/B]
Well, I honestly believe that you were told that, but I also honestly believe that it couldn't happen. Could be a handy excuse to cover up the fact that he was bouncing checks all over town. There is NO WAY that the same day a judgement is rendered, that an account is garnished. Again, I am not saying you made this story up, but I do believe you uncle isn't telling all....

No these were all incurred since my discharge so I couldnt include them - I ended up paying it off in full but at least the lawyer had to waste his time as well as mine. What really ticked me off was when the lawyer told me to my face in the hallway before court that all I would have had to have done was to go pay the ORIGINAL amount even after he got involved before we got to court ! I let the judge know that the debt place flat out lied to me and were still going to stick me with the attorney fees. She was ready to set a new date for me to challenge the atty fees and I said forget it - then it would just cost me ANOTHER 500 bucks to have him come back to court -

So I paid it and got them off my back

Did you get a stipulation from the judge that the creditor must remove the account from your credit report (which, incidently, would happen anyway).

So, did you end up paying the balance of what was owed, plus attorney's fees?

Yes, the judge ordered that as soon as the payment was received by the collections place that the stuff has to be removed from my credit report and then I also got it in writing from the debt place that they clear these out of their systems once a month and mine would be done on the next cycle. And yes I could have fought the fees, but I didnt feel like messing with it and going back to court again, taking time off work again, and then possibly paying for the durn lawyer AGAIN to show up, so I jsut cut my losses and paid it all. I did look at the laywer who I knew and patted him on the shoulder and said wow - your papa must be so proud of you (he is an attorney also) - making 500 bucks for 10 minutes time - keep up the good work

                and I walked out

I DO happen t know the judge - thanks very much - have known her since she got out of law school in the mid 70's actually and we used to socialize quite a bit in the same circles.
I guess knowing the judge did not help, after all.

Anyway, at least it is behind you.

I never thought knowing the judge would do any good - but yeah it is done and over with and they are gone !
