I would like to hear experiences from those who surrendered property in their ch 13, especially if it happened in Georgia. As the title says, I surrendered rental property in a 13. It took the bank 3 years to foreclose on the rental resulting in me owing the monthly HOA dues until the foreclosure sale date. I know the HOA can't try to collect from me while I'm in my 5 year ch 13 plan. But I'll soon be completing my plan & want to know what to expect. My lawyer said at my filing date that "hopefully it will go away", but both of us didn't know at the time how long it would take to foreclose. I'll owe about $ 9000 not including other fees they might want to add on. I don't know if the HOA will simply forget about the $ 9000. It's a lot of money & I know the HOA was hurting for money at the time of my filing (a lot of folks were foreclosing in the building).
So my questions is, what can the HOA do to collect this from me? I no longer own the property.
