    Not yet filed - new bank account joint or wife only?

    I'm filing Chapter 7 bankruptcy. I am married, however none of my debt is in my wife's name whatsoever. She is not filing bankruptcy.

    We need to close our joint personal bank account because with the same bank I have a line of credit in default, and I don't want any of our money (granted its always under a thousand) being able to be grabbed by them - whether they'd have the legal basis to do so or not.

    So, we're going to open a bank account at a different bank. My question is should the new bank account at the new bank be a joint account in both of our names, or just hers?

    I'd like it to be in just her name, but I don't want to be seen as trying to hide money. Again the balance is pretty much always under a thousand, and pretty much goes back to a few hundred dollars after monthly bill payments clear.

    The only money I get is an amount from my father every month to pay for our apartment, gas, electricity, etc. Perhaps he could write the monthly check to my wife instead of me from now on, and she could deposit it in her own bank account and pay the bills under her name only.

    I don't get a paycheck (I'm filing because my company failed...)

    Could we keep my name off of the new bank account, and have her do everything in her name only?

    Do yourself a favor. Check everything I say with a bankruptcy attorney. Most attorneys will even provide a free initial consultation. In fact, it's your life, so check everything anyone says (including your attorney) for yourself!

    Personally,............

    I'd leave the one bank acct open at the old bank. You have to declare any accts you've closed within the last year. So leave it open with $5 in it. If the Bank siezes it, so what.

    Open 2 new bank accts at a different bank. One in your name only and one in your wife's name only. You're obviously declaring some form on income for the BK. With 2 seperate accts, you can distinctly show your income as seperate from Wife's.
