Motion to dismiss!!

The U.S. trustee had filed a motion to dismiss my case because I recieved my credit conseling 1 day after I filed on 4-17-06. I was so upset. I thought my case would be dismissed and I would have to wait and start this horrid process all over again. I missed my hearing on the dissmisal motion that was supposed to be this past monday(7-17-06). I thought for sure the case would be dismissed. So being curious as to what the actuall outcome of the hearing was, I called the U.S. trustee and she was very upset with me because the judge denied her motion, even after I didn't show up.

I just thought I would let everyone know that there is a chance for pro se filers out there. This all should be behind me in about one more month.

The original trustee, who did the actual 341 meeting, just filed a motion with the court on my behalf recomending a discharge in my no asset case.

You are one luck SOB! The courts are probably so backed up in your area that the judge probably felt it was a waste of time even though you technically didn't play by the rules. Good luck.

Woah. You sure dodged a bullet there! There was a specific case reported several weeks ago about someone who did the exact same thing... they filed BK in a hurry to save their house which was going to forclose the next day... and in their hurry they neglected to get the financial counseling. They did that a day or two later, but the judge ruled that the new law said that he had no choice but to dismiss their case. He was really pissed about it too because he thought it was stupid. He ranted about how poorly written the law was and that it gave him no choice in something so small.
