    Post-filing credit card debit

    We filed chapter 7 three days ago and today I went to look at an old bank account and Amazon Credit Card (Synchrony) took a $29.00 (assuming a minimum charge) from the account. This account was at zero dollars so now I have the Amazon payment and a bank charge of $34.00..

    Are they allowed to take a payment after I file bankruptcy like this? Any ideas on how this should be handled? I was thinking disputing through the bank claiming it was not an approved payment and demand my bank charge be corrected but not sure.

    If they hadn't received noticed yet, they have done nothing wrong. But, I am pretty sure they will have to return the payment.

    Did you ask the credit card issuer to stop taking payments? If not, I'm not sure you can do anything about the $34 fee and I doubt the bank will be able to correct the $29 charge. From the bank's perspective, you owe them a post-petition debt of $63. It can't hurt to contact the bank and see what they are willing to do. But, I think you are going to need to contact the credit card issuer. Tell them that they are in violation of the automatic stay and that they should also reimburse you for the bank charge. They may not agree.
