Hi all, new to the forum, my wife is going to be filing a chapter 7 in new York state, she will be receiving a check for 8,000 at the end of June which is withheld during the year for the two months over the summer she does not work. If we file in April or May, would anyone know what happens to that check. Can the trustee take it or are we allowed to keep it. Thanks for any help!

Since it is income she already earned, it is probably an asset that needs to be listed on her petition and exempted if possible. She should confirm that with her attorney. If she can't exempt it, she may want to wait to file.LadyInTheRed is in the black!

Thank You for the feedback, I had hoped to file now so I let a few cards go without paying, I mentioned to Citibank we were looking into bankruptcy, we are 90 days late, the next bill said full amount due of 11k. Any thoughts on how to deal with citi now. thanks for any helpComment

First of all, have you confirmed with an attorney Ladyin the Red's post?
You're doing the right thing by letting cards go that will be discharged. You just have to deal with the collection activity until you file.Comment
