    HELP 2 yrs. post bk rec'd Notice First & Final Fee Application of Counsel for trustee

    Hi All we are 2 years post chapter 7 bk discharged in Dec. 2011. It has remained open because my FIL passed away during our bk and his estate only became settled recently. Today in the mail we received a document from the United States Bankruptcy Court from our state titled:

    Notice of First and Final Fee Application of Counsel for Trustee for the Period of December 12, 2011 - January 31, 2014.

    It further reads:

    blank, blank & blank filed an application for fees of $3615.50 and expenses of $107.50 for services rendered as attorney for the Chapter 7 Trustee. The fees and expenses will be paid out of the funds collected on behalf of the bankruptcy estate. The application may be reviewed in the Intake office at the US Bankruptcy Court.

    Your rights may be affected.....

    What does this mean?????? I thought we were done with this!!!!!

    When your bankruptcy stayed open in order to attempt to recover anything from your in-law's estate, the attorney hired by the Trustee to handle that pursuit (who may be the Trustee him/herself), had fees. In the Bankruptcy court, anytime an attorney wants fees, they need to "apply" for them through some sort of Application for Attorney Fees.

    I am thinking that your in-law's estate did yield something for the Trustee and they are paying their attorney (or his/herself) from the fees. The only way to tell is to look at your entire accounting and see what the Trustee's attorney obtained on behalf of the Estate.

    It is nothing for you to worry about, but I may personally double check to make sure every creditor was scheduled on your bankruptcy petition. This is because debts for unscheduled creditors in a Chapter 7 "asset" case are not discharged!

      JB is correct. The Trustee's attny is seeking approval of his fees which, once approved, will be paid from the fund the bk trustee is holding. Nothing for you to do or worry about as this is "par for the course".
