    Trustees Final Report Question

    I found this information on the uscourts.gov website and wanted to know if it is still valid:

    "The Trustee prepares this Report and submits to the US Trustee for review. The US Trustee has 60 days to review before filing the Report with the Court."

    I assume if it is still valid, that weekends also count in the 60 days. What if the US Trustee does not review, do it automatically get submitted to the local court?

    Also, has anyone received a copy of the final report? Do you find out who the trustee decided to pay and how much?

    If so, that is the website for the Bankruptcy Court in the Southern District of Inidiana. I can't find anything about the 60 days in the Bankruptcy Court or Federal Rules of Bankruptcy Procedure. Perhaps it is in the local rules of that court. It could also be an internal policy of the U.S. Trustee.

    Whether it is 60 calendar days or 60 court days depends on the source of the deadline. If nothing is specified in the source, then Rule 9006 probably applies and you would count the weekends: http://www.law.cornell.edu/rules/frbp/rule_9006

        I fixed your link. It is another page at the the Southern District of Indiana website. Note the "insb" in the URL before "uscourts.gov". Each US court has it's own site at uscourts.gov. Your user name suggests otherwise, but are you in the Southern District of IN?

        The US Trustee's Handbook for Chapter 7 Trustees says nothing about the 60 days. But it does say that the final report is filed with the court after the U.S. Trustee's review. (The final report is discussed on pages 4-31 and 4-32). I have no idea where the 60 days comes from or if it applies to other courts.
