    Wells Fargo Personal Loan

    Hello everyone. I have a Wells Fargo personal loan that I am including in chapter 7. They sent me a letter yesterday saying that I have a past due amount and that I needed to pay it immediately before they start collection proceedings. Are they even aloud to start collection proceedings? I thought by filing Chapter 7, that would protect me. Should I contact them and notify them of my filing or hand the letter over to my attorney?

    One more question GE Capital calls three times a day still. Should I refer them to my attorney or just keep ignoring the calls?

    Refer those calls and letters to your lawyer.

      have you actually filed yet? if you have not filed those creditors have a right to continue to collect from you. if you have actually filed have a docket number, then those creditors are in violation of the bk code and should be reported to your atty immediately.

      our atty wrote all our creditors and sometimes that's enough, but not always, not until one's petition is actually filed.

        I filed 8/20 and had my 341 meeting 9/24. I contacted my attorney's office today and they told me to ignore the calls or I can offer them my case #. They also said that the letter can be ignored since the personal loan was included in the bankruptcy. I think I am going to call them Monday have them send a letter notifying these companies of the filing so I can have peace of mind. Thanks for all the feedback.

          I checked Pacer today and my trustee updated my information with no distribution/ no funds and it said that the case is not subject to dismissal. What a relief it is to see those words in black and white print! I couldn't have gotten the courage to file without all of your guidance here. Thank you all!!
