    The waiting game, how long did you wait........

    I was an asset case, filed in Nov., discharged in Feb.

    Abandonment Finalized, No Objections mid June.

    The trustee has had the asset check since April.

    So, does the trustee deposit the money, and take his good old time to prepare the final trustees report so they can make a few extra pennies in interest? I just don't see why it takes months and months to finalize the report and submit it for final approval by the courts.

    Also, just wondering, who gets paid first in an asset case? Mortgage holders, credit cards, the trustee??

    Any thoughts.?.?

    In our case, it was the IRS, the IRS, and the IRS. A medical provider motioned the court to prioritize their claim above that of any others. It was eventually whapped down, but each side had to go through the proper court rules, i. e., each side had a certain number of days to respond, and the other side had a certain number of days to answer back, and that sort of back and forth bickering.

    The medical provider is the only entity that made a claim. The two CCs did not, neither did American General, who tried to trick us into signing reaffirmation papers at our 341, or the car loan that 'Hub foolishly cosigned for an acquaintance. (The acquaintance got stuck with the judgment because he was too stubborn to file BK.)

    We waited about 16 months before our Asset case closed.

      ours was super fast. it closed within about nine months of discharge i think. we bought back our assets and there were no objections.

        It's more than just the trustee getting the check. All the checks that the trustee writes must clear, then the final report/audit, then request for closure.

          We are going on 2 years 7 months and it is not disharged. This is what pacer said on Sept 4--- Order Approving Account Discharging Trustee and Closing Estate Chapter 7. It said case was filed as closed on Sept 4. Never in my wildest dreams did I think it would take this long to close. Our lawyer has been very very poor in keeping us up to date. Thank goodness for pacer, I would have no idea where the case was if it wasn't for pacer.

            The trustee's assistant told me that the squeaky wheel usually gets done first, but I don't want to be a bother then get pushed to the bottom of the pile.

              many of these assets cases take YEARS to close. the only thing one can do is wait as suggested or if it gets way out of hand your atty needs to file a motion to compel, which means you are asking the court to order either the opposing party or a third party to take some action. in this case it would be the trustee.

                Call 'em. Nothing wrong with that as long as you are polite. It's your life they are holding up...nothing wrong with asking when you might be able to get going on your "fresh start." Maybe start the conversation by asking if they have everything they need from you or if there is more you can do to help the process move along smoothly.

                I've been following a case for over three years now. I think they call it an "ASSett case" because that is where the greatest pain is located. Patience is a virtue, but you DO have rights and stuff does get lost in the shuffle, etc. I don't necessarily subscribe to the "squeaky wheel" idiom, but I have been know to stay in close contact with people to make sure they have everything they need...even though they assured me they did last week, and the week before, and the week before that.

                  I've got 6 more months on the buy back, but when finished, thinking about dropping off a nice bottle of Crown at the trustee's office.

                      $143,000 in debt discharged for $36,500, including attorneys fees. Money well spent!
