    I'm discharged and case closed!!!

    I just wanted to share my joy after having this bankruptcy cloud lifted off my shoulders. It's been a long bankruptcy journey as I originally filed a Ch.13 bankruptcy back in 6/2/08 and later converted to a chapter 7 on 5/13/13. After entering the 60 day club after a short sweet and simple 341 meeting it was generally smooth sailing until one creditor threatened to contest my case because I obtained additional debt from them while I was still in my chapter 13 prior to conversion. I was at ease when I figured the creditor was just bluffing and no creditor and/or trustee objections were filed prior to the deadline of 8/12/13. As of 8/16/13 the court has finally issued my discharge and closed my case.








    6/02/08 - Filed Ch. 13
    8/28/08 - Ch. 13 Plan Confirmed
    5/13/13 - Converted to Ch.7

    Is it just me, or are there a lot of discharges grouped together right now?

    Chapter 7, above median, no asset. Discharged with no UST involvement.

            Congratulations. The reason that "new" debt is dischargeable in a case converted from Chapter 13 to Chapter 7, can be found is 11 USC 348(d). Trust me, some creditors do not now this! I had to not only threaten one creditor, that was adamant that the pre-conversion debt was non-dischargeable (because it was a specific type of debt), I was one day away from a final evidentiary hearing before they settled.

            So, I don't think they were bluffing. They just didn't know until their Bankruptcy attorney looked at it.

              Well I initially qualified for a Ch. 7 prior to filing a CH.13 in June 2008 but I wanted to keep my car and I was already behind in car payments so couldn't reaffirm. So the other option left to save my car was to file a CH. 13 and make my payments via Ch. 13 payment plan. The Ch. 13 plan payments were 100% going to the creditor of my vehicle and the remaining creditors were getting 0% in my confirmed plan. Initially this worked out because not only did I have a lower interest rate but my monthly payments were way lower than my pre-petition payments to the creditor.

              But over the course of my Ch. 13 plan my car has increasingly gave me trouble and I had incurred more debt caring for it. I though that after having all the necessary repairs done that I could continue maintaining it until my Ch. 13 plan was completed and have a paid off car. But my car just couldn't make it to the Ch 13 finish line and broke down again and that's when I wanted to just put the car out of its misery. So I decided to convert my case to a Ch. 7 and surrender it back to creditor. I should have done this earlier in my Ch. 13 case during the first signs that my car would not last the entire period of my Ch. 13 plan. Well it's over with and I can finally move on.

                Cograts!! Let's hope they "group" my discharge very soon - it's been 66 days since my 341 and still not yet discharged.

                  Thanks for the explanation gman. I wish I would have bought a car as mine need occasional repairs and of course it mostly happens at the worst times.
