    Does online filing BK sites work?

    I just recently got a court summons from a creditor. I'm looking into filing BK and i don't have the money to hire a lawyer since it seems like the cost will be $1200 or more. I've come across sites such as Millerbankruptcy.com and USABKASSOCIATES.com. Anyone have any experience with these sites? I've got around 6k total in debt and I'm currently recieving unemployment... should i even think about BK? I don't own any assets at all, just a old car. Any help would be appreciated.

    Noway you should file ove $6k.
    Your best course of action is just put on a ful court press to find a job. Once you get some money coming in, you can start trying to negoiate some settlements.

      I agree do not file over 6k. Try your best to find a job and work on paying it off.

          Go see a BK lawyer for a free consultation. I believe, like the others here, that it is not in your best interest to file BK on $6K of debt and no assets or job. I think the lawyer will tell you the same thing. Who is the creditor as others on this site may have experience with them?

            Same here.

            Besides the low amount of debt, you have no assets to protect. Unemployment can only be garnished for spousal and child support and taxes. If the creditors want to sue you, let them. If somebody gets a judgment, make sure you don't keep cash in the bank where they can get at it.

              If you only have 6K ind debt, you need to try working on paying that off.

              That means discipline on your part. That means foregoing that cappuccino frappe or whatever it is that you 'can't do without'. Put that money into your piggy bank, and when the piggy bank weighs a certain poundage, take it to your REAL bank or CC and deposit it.

              Keep doing that, and you will eventually pay your debt off.

              Yes, I know that you want to go out to eat and have a nice dinner now and again; you SAVE and PLAN for it. You are now no longer able to go where you want and pull out a plastic card to pay for it.

                Thank you for everyone's response. The law firm is Neuheisel from Sacramento and originally for GE money for a dental credit card. Their suing me for about 4k I was just thinking of other credit cards in the past that added up to 6k. If I do choose to ignore them and let them win judgement. What happens if they can't any money from me and I have no assets? I read somewhere that the courts can have a arrest warrant out for me. From reading everyone's responses I don't think I will go for bankruptcy with such a small amount of debt. I got a court summons with no date of a hearing. Which I thought is weird. Thanks again everyone for the help.

                    Some one can correct me if I'm wrong but I don't think we have a debtors jail anymore and if we did a whole lot of famous and not so famous people would be in it

                      The only way youcould be jailed is, you don't comply with a debtors exam {if ordered}. Then, you're in contempt of court. You won't be jailed for being unable to pay.

                        well debtor jail is really not "gone" if you get issued a bench warrant for an unpaid anything i.e. child support, traffic ticket the court can issue the warrant and put your butt in jail. as keepmine says it's really dealing with contempt of court orders

                        we discussed this once before on the forum and of course if you have a summons for a law suit of non payment of your 60 inch tv from best buy, i assure you, you are not going to jail ( there are a few exceptions to the rule such as fraud etc), but they are far and few between.

                        as everyone here as advised, it is best to work out a payment plan on this debt rather than to attempt a bk for most seems to appears a relatively small amount. (many of us filed will well over 200k worth of debt). and while it may seem like a world of money to you, which it mostly like is, i'm sure you can get them to work out a payment plan. best of luck!

                          Absolutely not. If that were the case, I would have been put away for life for the amount I quit paying.

                          You are required to cooperate with the court and not lie to them. But you cannot be arrested for just not paying a creditor, judgment or not.

                            Not weird at all. You have 30 days from the date the summons is served on you to file a response. If you don't file a response, the creditor will file a request for default judgment and if you don't oppose it, the judgment will be entered without a hearing. If you file a response, it will still be some time before a trial date is set. However, you might have to show up for a case management conference or other hearings, depending on how the case goess.                               Which is not the same as debtor's prison. Nobody goes to jail because they can't pay a debt. They go to jail for not complying with a court order. If you receive an order that says "you must appear on ________ date", show up and you won't go to jail.
