I get paid in the low-mid $100K and have over $50,000 in CC debt thanks to a long divorce.
I spoke to a BK lawyer who said point blank that I likely won't qualify for Chapter 7 even though i have no money left after each paycheck. He pushed hard for Chapter 13.
My biggest monthly expenses include $1,000 in student loans, $1,450 in child support, $1,200 rent/utilities, $400 car, $1,000 that i try to apply to my CCs, and $900 in travel expenses to see my child once a month (ex decided to hightail it to another state). After taxes, I take home over $6,000 each month so as you can see, the expenses listed above drain my whole paycheck and don't leave money for anything else.
What sucks is that many of these expenses (travel expenses, student loans, CC payments) don't get calculated on the means test.
I'm in the process of consulting with several lawyers but would appreciate any insight as to whether I can qualify for Chapter 7 under these circumstances.
