Okay, so we had our 341 yesterday morning. Before we went on the record, the trustee wanted to know why we had over $150,000 in debt, which we explained. He stated that the Dept. of Justice would probably need to review and investigate our bk since our debt was over 150k. This is the first time we had ever heard of this. No one in our attorney's office spoke to us about it at all. Also, I noticed with the people who went before us, the trustee simply used a computer and entered their responses to his questions right on the keyboard. With us, he wrote the responses on a bunch of papers. I cannot reach our attorney. We filed ch. 7. Should we be worried?

I've never heard that the DOJ (i.e., the U.S. Trustee) will investigate because of debt over $150k, but it's possible there is such a guidline. The U.S. Trustee evaluates every case for abuse and it is possible that higher debt causes them to look more closesly. They probably look for a pre-BK spending binge, hidden assets or signs of you transferring assets to others to keep them out of the hands of the trustee. I wouldn't worry unless there is something specific that you know could cause a problem. A review and investigation is only a problem if there is something for them to find.LadyInTheRed is in the black!
