    Tax question

    Hubby is in process of being dismissed on his chptr 7 most likely, and he is not going to file a 13. He owes IRS 4000, We want to go ahead and pay it in next few days.

    Since the IRS got notice of chpt 7 filing, is there any problem doing that, or should we wait for the dismissal.
    We just do not want IRs sending our money back to trustee or such.

    I think I'd wait until you're formally dismissed.

      When did you get the $4,000? If it was money earned after you filed BK, I think it is safe to make the payment because the money is not part of the Chap 7 BK estate. Also, if you had the money at the time your husband filed BK and it was listed on the petition as exempt, and the time to object to exemptions has expired (30 days after the 341 was completed, assuming nobody applied for an extension), you should be able to pay the IRS. Check with your attorney to be sure.

        The money is earned after the petition , Just talked to attorney, he said to go ahead and pay it.
