    2004 Exam

    The trustee filed a motion to dismiss for our Chapter 7. Our attorney filed an objection and provided documentation to the motion to dismiss. Now the trustee wants to have a 2004 exam. Has anyone else ever had this happen to them? What can we expect to happen?

    We are over median income and are surrendering our rental house in FL. The house in FL is a nightmare that NEVER ENDS!

    Yes, we have. In our case, our trustee wanted to know what happened to the proceeds from a mortgage note that we sold prior to filing BK. Our attorney never told us that we shouldn't have done that. We were also never told about 'preferential insider' payments, what they were, or not to make them. So we paid back a loan from a SIL and another to a God-daughter.

    So you will be questioned about whatever your issue is. Does your 2004 Exam have a 'letter'? Ours was a 2004b Exam.

      According to the motion to dismiss, the trustee assumed my husband's expense checks were undeclared income, medical and dependent care reimbursements were undeclared income and transfers of cash from one bank to another bank were undeclared income. We have provided copies of the expense reports, documentation from the spending accounts and bank statements from both banks. Our attorney is not sure what the trustee is questioning anymore.
