    Does anyone heard or know if Miami judges have granted second mortgages lien strips? Any information would be greatly appreciated.

      I dont think the value of the second matters - ours its over a mil! LOL. That is only because it was tied to other real estate though, our house isnt worth anything near that. <cross your fingers>

        Sorry I did not pick up on this thread until today (been slowing down on the board due to being over-worked). Still no movement in my district but, who knows. Keep us posted on your research. There might actually be some attnys following this.

          Update. Motion to strip second..GRANTED!!! yep, was notified today and it says Bank of America did not object so buh bye BOA!! It was 14k, and my payments doubled in January, so it saves me 150.00 a month..Happy camper here. Good luck to the other folks in trying to get theirs stripped too. Glad I'm in the Middle District.

              Congrats! And yes, the Middle District is just a freakin' great district, huh?

              Tomorrow, we are mailing out the final installment to our attorney and after that, we only have to get our paperwork together (my mother already finished the pre-filing course). So only a matter of days before she can go ahead with her CH7.

                well, the middle district is nice until those trustees send someone over to your house to appraise your stuff LOL!!

                  Hmm, we recently updated almost our entire furniture - BUT I was the one who purchased it.

                      BTW, does anybody of you experts know if my mother could use the $4,000 Wildcard since our home is underwater? I stumbled over some info online that this might be an option if you want to keep the home but the homestead exemption wouldn't be used due to having no equity in the first place. I also read that there are some "mean" trustees out there who would then attempt to get you out of your home if you would NOT use homestead - and that's something we certainly want to avoid.

                      $1,000 as exemption would be a bit low for my mother - $4,000 would easily cover everything she owns.

                        They sent an appraiser over to my home last week..no worries, as I have mostly thrift store belongings. I got the copy of the appraisal already and came under the 1000.00 limit. She was very nice and we spent most of her time her sharing stories about our pets. My kitty got out the door when I opened it to let her in and she helped me retrieve her. It was uphill from there. Good to have a fellow animal lover sent out by the trustee!! Oh, and she listed my sofas value as"severely damaged"..that would be the one specifically bought from goodwill for the cats to sharpen the claws..Ha! Hey, Im not proud, just a kitty momma here. With my second being stripped and the appraisal done( I was asked to pay her invoice of 144.00, and they would not go after my refund if I did) and paying the 144.00 appraisal fee, looks like I'm close to discharge. Cant wait.

                          i'm so happy to hear it went smoothly for you blue.

                          to me it's just the thought of it gives me the creeps. we didn't have to worry about it at the time. we lost our home of over 30 years and really were staying with or at someone's home with nothing when we filed. so the court i guess had no interest in our few items left. we sold everything for the move and was able to prove it so that went fine. also things are changing nowadays. the courts seem to send appraisers out more often than when we filed.

                          now that was more than a few years back. we have since brought a home, and a new life! so glad it will be over for you soon
