    Household purchases prior to Bankruptcy

    My husband and I are filing for Chapter 7. Initially, we were to file just before our payday so that we wouldn't have anything in our bank account. At the advice of our attorney, we spent down our account on necessary items and delayed the purchase of some things. We bought groceries, a few clothing and shoe items, gas and rent, etc. Our filing was delayed, so payday rolled around again. We paid all the normal expenses but found it necessary to pay for some other things- namely the reservation of a hotel room online for Christmas. We had to do it on this paycheck since we would be paid next AFTER Christmas. It was a $110 purchase. We also purchased bedding for our bed, as we were sleeping on old blankets and a $50 DVD player (we have no cable or antenna access) as ours was broken by our toddler. Every other expense was basic food, utilities, etc. I am so worried that the trustee in our case (now set to file on the 1st) will see these expenses as "frivolous" when we have not intentionally bought anything that we didn't need. Should I be worried? My attorney is out for the holidays until Tuesday.

    I would not be worried. You did not mention one "luxury" item in that posting. Everything, except maybe the DVD, was for your living costs and/or costs to produce income. I would not even worry about the DVD as it was insignificant (but does add to the value of your personal property).

        Would agree with the others. Nobody will care about a $110 hotel room or a $50 dvd.

          Especially if you paid cash instead of using a credit card.

              Don't worry about it. I spent almost a $100 on one outfit for an office party (I literally had not bought anything nice for work in a long time and it was expected to be a little dressy) just before I filed. Nobody even asked about it.
