    Chapter 7

    Hello,

    Just a quick question about the schedule J. My family and I have a usual income of $25000 a year for a family of four in Arizona, so we fall way below the means test for median income. I am currently unemployed but hope not for long I hope. I am confused with the contradicting things I read about schedule J. For the expenses that we have right now being that I am unemployed I spend next to nothing on food and other needs for my family. We plan on filing around Feb 2013, if I am still unemployed would I put the expenses that we currently have that are not enough to support a family for long OR do I put the expenses that my family should have to reasonably support a family of four which is very close to the allowances the state gives me. I am looking to file chapter 7 and would like a financial do over. I can't remember when the last time it was that was debt free. Any body that has been through this please chime in, I would greatly appreciate it. I will give back to the BK forum as much knowledge as I can while going through this ordeal. I find myself staying awake at night reading and reading and getting discouraged and happy and discouraged. I just need help understanding how it works. Thank you for your time and care..

    Hi and welcome to the Forum.

    You are in the planning stages right now, and things may well change before you file in 2013. Are you consulting with any attorneys yet, or are you trying to do this yourself? The reason I as is that even with a free consultation, the attorney will want to see your bank statements for the last 6 months. And the closer you get to your filing date, you may be asked for another set of bank statements.

    I suggest going ahead and making out two lists--one is the bare-bones minimum that you can provide for your family now, and the other will be the usual standard one that a family your size would reasonably require.

    Is anyone else in the family working? Are you getting Unemployment Compensation?

    I see you are in Arizona. One of our members is a practicing BK attorney in Arizona, and will be able to give advice more specific to your situation.

      Thank you for your response, yes I have consulted with an attorney but she has only given me vague answers, she says that she will max me out on the allowances. My wife is working at the moment but she only brings in about $800 a month and I am making about $240 a week Unemployment Compensation. I am kinda worried about the bank statements not showing a whole lot since we are not spending what would be normal for the family size. We have turned off TV and food is about $50.00 to $70.00 a week, just the very very very basics to live and keep the house and car. I am just afraid that the trustee will say that this is what he has seen us spend on our bank statements and that is it. Of course when I get a job what we spend now will leave us with an amount of disposable income that will not be realistic.
