    Questions about being part of the 60 day club.

    Once you became part of the 60 day club:

    1. If an adversary proceeding was going to be filed, when would it be filed?

    2. If a Trustee wanted to dispute (question) your Chapter 7 , when would he done do it?

    An AP can be filed any time during your 60 days, up until the last day. In our case, the one filed against us came about 3 days before we were scheduled to be discharged originally. However, we were ruled an Asset case and our discharged got pushed back 30 days because of that, not the AP being filed.

    The trustee can dispute your Ch7 at any time during the 60 days. It will not usually happen after 10 days, unless some new information turns up in your case that was not known before. In our case, an Enemy wrote an anonymous letter to our trustee stating his 'concerns and suspicions' that were enough to pique the trustee's interest.

    Usually this does not happen unless you do have an enemy. Do you?

      No ememies except for credit cards :-) If a credit card was to file a AP, how would I know about it???

        It is unlikely that a cc will file, but if they do, you will get a notice from the BK court. You will be given an opportunity to respond, just as in civil court.
